Nghe An Provincial People's Court has just opened a first-instance criminal trial of Lang Van Cuong (born 1962), residing in Chau Binh commune (Quy Chau) for the crime of "Murder in a state of extreme emotional agitation".
Mr. Lang Van Cuong has a son named Lang Van Kh. (born in 1987) - a drug addict, infected with HIV in the final stage. Addicted and unemployed, Kh. often asks relatives for money to buy drugs. When his demands are not met, this son threatens and curses.
On the evening of January 12, 2020, Kh. came home in a drugged state and asked his mother for money but was refused. The child then cursed, held a syringe in his hand, threatened the whole family, and kicked the dinner tray away. After that, Kh. held a knife and threatened to slash the whole family. Too angry with his son's actions and to stop the dangerous behavior, Mr. Cuong used a stick to hit Kh. on the head, causing his death.

At the trial, the defendant admitted all his crimes. Mr. Cuong said he was so angry at his son’s drug use and threats to kill his entire family that he could not control his actions. The defendant asked for a suspended sentence so that he could take care of his children.
The jury found that the defendant’s murder was a violation of the law. However, in this case, the victim was a drug addict, HIV-infected, and frequently harassed his family, asked for money, and threatened relatives. The defendant committed the crime in a state of extreme emotional agitation.
In this case, the defendant had mitigating circumstances such as surrendering, honestly confessing, repenting, committing the crime for the first time, and the legal representative of the victim requested consideration of a reduced sentence for the defendant.
Considering the case as a whole, the court sentenced Lang Van Cuong to 30 months in prison but suspended the sentence, with a probation period of 60 months for the crime of "Murder in a state of extreme emotional agitation".
