Despite "taking down" David Luiz, Aguero still escaped punishment from the FA.
The English Football Association (FA) has confirmed that Sergio Aguero will not face any punishment for his extremely rough tackle on Chelsea's David Luiz in the FA Cup semi-final.

The FA's decision came after confirmation that referee Chris Foy had witnessed at least part of the incident and made his decision. Foy only awarded Chelsea a free kick, and Aguero did not receive a card. The reason the Manchester City striker escaped a three-match ban from the FA's disciplinary committee is due to a precedent set by a similar incident involving Callum McManaman at Wigan.
Slow-motion video footage showed Aguero kicking David Luiz in the leg in retaliation for the Brazilian defender elbowing him in the chest earlier. However, the FA could only take action once referee Foy and his assistants admitted they did not see the incident. But the fact remains that an assistant referee was standing near the touchline close to where Aguero's violent tackle occurred.
That position allowed the assistant referee to observe the situation, and that helped Aguero avoid a three-match suspension. A similar incident occurred last month when Callum McManaman of Wigan also escaped a ban after a brutal tackle on Massadio Haidara of Newcastle at the DW Stadium because the incident happened about 10-15 meters away from an assistant referee who was watching the violent play.
When Aguero tackled David Luiz and referee Foy decided to award Chelsea a free kick, it showed that he had observed or been informed of the incident and was completely proactive in his decision to award the penalty, so the FA Disciplinary Committee did not discipline Aguero.
