Cases of suspending college operations
The Ministry of Education and Training has just issued Circular 43/2011/TT-BGDĐT amending and supplementing some articles of Circular 14/2009/TT-BGDĐT on the Charter of Colleges.
Accordingly, the Ministry stipulates that one of the prerequisites for establishing a college is having a complete organizational structure in accordance with the approved establishment dossier. It must have a full-time faculty and management staff with sufficient capacity to develop and implement training programs, ensuring a ratio of no more than 25 students per faculty member for each knowledge area across all training disciplines, with at least 15% of faculty holding a master's degree or higher.
Furthermore, it is necessary to ensure sufficient classrooms, libraries, appropriate functional rooms, laboratories, practical training facilities, and other physical facilities to meet the requirements of the training program. The average area of buildings already constructed and put into use must be at least 9m²/student, of which the minimum learning area is 6m²/student, and the minimum living and accommodation area for students is 3m²/student; there must also be sufficient office space for lecturers and staff of the school with a minimum area of 8m²/person.
This circular also clearly specifies the cases in which a college's training activities may be suspended. Specifically, there are five cases of suspension:
1. Engaging in fraudulent activities to obtain permission to conduct training activities;
2. Failure to meet one of the conditions for registration of operation;
3. The person granting permission for the training activity does not have the proper authority;
4. After 3 years from the date the Minister of Education and Training signed the Decision allowing the training activities, the school did not enroll students or organize training;
5. Violating regulations of the law on education, resulting in administrative penalties at the level of suspension.
Thus, with the new regulations, the Ministry of Education and Training has added more cases where training activities can be suspended due to violations (the old regulations only listed two cases where colleges could have their training activities suspended: Violating legal regulations on administrative penalties in the field of education to the extent that suspension is required; and For objective reasons, the school cannot ensure normal operation to meet the requirements of a college).
After the suspension period, if the college rectifies the causes leading to the suspension, the Minister of Education and Training will consider and decide whether to allow the college to resume its training activities. Colleges are dissolved in the following cases: serious violations of regulations on the management and organization of college activities; failure to rectify the causes of suspension after the suspension period; the college's objectives and activities no longer align with the socio-economic development requirements of the region and locality; according to the planning and restructuring of the network of universities and colleges to suit the actual situation and conditions; and at the request of the agency, organization, or individual that established the college.
* Deputy Prime Minister Nguyen Thien Nhan has instructed the Ministry of Education and Training to finalize the draft Decision on adjusting and supplementing the Plan for the network of universities and colleges for the period 2006-2020, and submit it to the Prime Minister before October 15, 2011.This adjustment must be based on the Vietnam Human Resource Development Plan for the period 2011-2020 and include forecasts of human resource needs. Simultaneously, the student-to-lecturer ratio in universities and colleges must be reduced during the 2011-2020 period; consequently, the scale of university and college lecturers should be recalculated according to regions and periods. The planning of the number of universities and colleges and the number of students must be consistent with the Vietnam Human Resource Development Plan for the period 2011-2020, which has been approved by the Prime Minister.
