Prosecution of 'husband' who raped 'wife' until she gave birth

Due to emotional conflict, N. took her child back to her mother's house to live. She then filed a complaint against her "husband" for raping her, leading to her giving birth to a child before she was 16 years old.

On May 5, the People's Procuracy of Tien Giang province issued an indictment to prosecute Thai Van Phao (29 years old, residing in My Quy hamlet, Phu Quy commune, Cai Lay town, Tien Giang province) for the crimes of Rape of a person under 16 years old and Sexual intercourse with a child.

According to the indictment, 6 years ago, Phao and Nguyen Thi Kim N. (born April 4, 2001, residing in Cai Lay district, Tien Giang province) had a romantic relationship with each other. On January 9, 2014, Phao took N. to a hotel in Cai Lay town to have sex.

Then, Phao took N. to the bus station to go to Binh Duong to work.

Phao agreed to compensate the victim 20 million VND and support 1 million VND/month to raise N's child until 18 years old.

Four months later, N. called Phao to say she was pregnant. The two families held a wedding for Phao and N. but did not register the marriage. In September 2015, N. gave birth to a baby girl. The results of the examination showed that this girl was Phao's biological child.

During their time together, Phao continued to have sexual intercourse with N. many times when she was under 16 years old. However, later, a conflict arose between Phao and N., so N. returned to her mother's house to live.

On March 28, 2018, N. filed a complaint with the police about being raped and having sexual intercourse with her “husband” when she was under 16 years old, leading to the birth of a child. The police started an investigation and by the end of December 2018, temporarily detained Phao for the above-mentioned behavior.

At the investigation agency, Phao confessed to the crime as stated. Phao's testimony was consistent with the victim's testimony, the witness's testimony, the expert's conclusion and other evidence in the case file.

Regarding civil liability, the representative of the victim N. requested Phao to be responsible for supporting his daughter, 1 million VND per month until she turns 18 and compensate for mental damage in the amount of 20 million VND. Phao agreed and compensated 20 million VND on March 18, 2019.
