From April 1, employees can work no more than 300 overtime hours in a year.
(Baonghean.vn) - Resolution 17/2022/UBTVQH15 on overtime hours in 01 year, in 01 month of employees in the context of COVID-19 prevention and control and socio-economic recovery and development, was approved by the National Assembly Standing Committee at the 9th Session.
1. Allowed to work overtime for more than 200 hours but not more than 300 hours in 1 year
Regarding overtime hours in a year, it is regulated as follows: In case the employer has a need and has the consent of the employee,workers(Employees) are allowed to use overtime for more than 200 hours but not more than 300 hours in 1 year, except in the following cases:
- Employees from 15 years old to under 18 years old;
- Employees are people with mild disabilities with a reduced working capacity of 51% or more, severe disabilities or especially severe disabilities;
- Employees doing arduous, toxic, dangerous or especially arduous, toxic, or dangerous jobs;
- Female workers who are pregnant from the 7th month or from the 6th month if working in mountainous, remote, border, or island areas;
- Female workers who are raising children under 12 months old.

The above provisions do not apply to the cases specified in Clause 3, Article 107 of the Labor Code:"Employers are allowed to use employees for no more than 300 hours of overtime per year in the following industries, occupations, jobs or cases:
a) Production and processing for export of textile, garment, leather, footwear, electrical, electronic, agricultural, forestry, salt and aquatic product processing;
b) Production, supply of electricity, telecommunications, oil refining; water supply and drainage;
c) In cases where work requires highly skilled and technical workers that the labor market cannot supply fully and promptly;
d) In cases where urgent work must be resolved that cannot be delayed due to the seasonal nature or timing of raw materials or products, or to resolve work arising from unforeseen objective factors, consequences of weather, natural disasters, fires, enemy attacks, power shortages, raw material shortages, or technical problems of production lines.
2. Allowed to work overtime over 40 hours but not more than 60 hours in 01 month
Regarding overtime hours in 1 month, the Resolution clearly states: In case the employer is allowed to use employees to work overtime up to 300 hours in 1 year, if there is a need and with the consent of the employee, the employer is allowed to use employees to work overtime for more than 40 hours but not more than 60 hours in 1 month.

The Resolution takes effect from April 1, 2022.
