According to the Ministry of Finance, starting today (April 1st), organizations and individuals who have not yet submitted their personal income tax returns will be subject to administrative penalties for tax violations if they have tax liabilities.

Furthermore, according to the Law on Tax Administration, at the end of the calendar year or fiscal year, businesses must submit a final income tax return to the direct tax authority. The deadline for submitting the final income tax return is no later than the 90th day from the end of the calendar year or fiscal year; the settlement of fees and charges coincides with the tax settlement period.

Therefore, the tax settlement for 2013 had to be submitted before yesterday (March 31st). After this time, depending on the time and severity of the violation by each business, the tax authorities will issue administrative penalties for each case.

Therefore, by April 1st, organizations and businesses that have not submitted their 2013 tax returns may face administrative penalties of up to 200 million VND, while individuals may face 50% of the penalty for organizations, meaning a maximum fine of up to 100 million VND.

A fine of VND 2,000,000 to VND 5,000,000 will be imposed for any of the following acts: Submitting tax declarations more than 40 days but less than 90 days after the prescribed deadline; Submitting tax declarations more than 90 days after the prescribed deadline but without any tax payable; Failing to submit tax declarations but without any tax payable; Submitting quarterly provisional tax declarations more than 90 days after the deadline but before the deadline for submitting the final tax return...

The above penalties do not apply to cases where the deadline for filing tax returns or paying taxes is extended in accordance with tax administration laws.

Notably, once an administrative tax violation has been subject to a penalty decision or a penalty record issued by an authorized person, a second penalty decision may not be issued for the same violation. If the violation continues despite being ordered to cease by an authorized person performing their duties, aggravating circumstances will apply as a penalty...

The Hanoi Tax Department announced that as of March 30th, 25% of individuals and businesses had still not submitted their tax declarations. The deadline is 24:00 on March 31st, after which the tax authorities will close the books, and from today onwards, taxpayers will be subject to administrative penalties for tax procedure violations.

Previously, to provide the best possible convenience for taxpayers, during the peak period until the end of March, the Tax Department and its branches worked every day of the week, including Saturdays and Sundays, to ensure that taxpayers' documents could be received fully and promptly.
