From tomorrow, June 10, 2019, Decree 35/2019/ND-CP regulating administrative sanctions for violations in the forestry sector will be applied.

This Decree states that common and dangerous acts for forests and humans such as setting fires, using fire to hunt wild animals, collecting honey, collecting war scrap... can be fined from 1.5 to 3 million VND.

The Decree also clearly states: The act of hunting, killing, raising, or confining wild animals in violation of regulations shall be subject to a fine of 5-400 million VND; in addition, a number of additional penalties shall be applied.

Acts of cutting, burning, clearing forest trees, digging, digging, leveling, blasting; building dams, blocking natural flows, discharging toxic substances... causing damage to forests for any purpose without permission will be fined up to 200 million VND.

According to the Government Portal, the fine for administrative violations specified in Decree 35/2019/ND-CP is the fine applied to individuals; the maximum fine in the forestry sector for individuals is 500 million VND. Violating organizations will be fined twice the fine for individuals with the same violation and level of violation; the maximum fine in the forestry sector for organizations is 1 billion VND.

In particular, the Decree specifically stipulates the fine for illegal forest exploitation. Accordingly, illegal exploitation in production forests for common wood species will be fined from 500,000 VND to 1 million VND for illegal exploitation of less than 0.4 m3plantation wood or under 0.2 m3natural forest wood; fine from 1-5 million VND for illegal exploitation from 0.4 m3 to less than 1 m3plantation wood or from 0.2 m3to under 0.5 m3natural forest wood;... fine from 70-100 million VND for illegal exploitation of 15 m3 - 20 m3 plantation wood or from 7 m3to under 10 m3natural wood

For wood belonging to the List of endangered, precious and rare forest plants and animals Group IIA, a fine of 1-3 million VND will be imposed for illegal exploitation of less than 0.3 m3 plantation wood or under 0.2 m3natural forest wood; for illegal exploitation from 0.3 m3 to less than 0.5 m3plantation wood or from 0.2 m3to under 0.4 m3Natural forest wood will be fined from 3-7 million VND;... fined from 150 - 200 million VND for illegal exploitation of 10 m3up to 15 m3plantation wood or from 5 m3up to 7 m3natural wood

For wood belonging to the List of endangered, precious and rare forest plants and animals Group IA, a fine of 10-25 million VND will be imposed for illegal exploitation of less than 0.3 m3; for illegal exploitation from 0.3 m3to under 0.5 m3will be fined from 25-50 million VND;...fine from 75-100 million VND for illegal exploitation of 0.7 m3to under 1 m3.
