Nghe An Provincial People's Committee requests to completely resolve 83 pending investment project dossiers

Many investor profiles are slow to add information.

According to the report of the Department of Planning and Investment, after reviewing investment records and procedures in the province, as of January 31, 2023, there were 83 pending records of non-budget investment projects that had not been resolved.

Specifically, out of 83 dossiers, the Department of Planning and Investment has sent a document to the investor notifying it to stop processing according to the provisions of Clause 1, Article 6, Decree 31/2021/ND-CP, dated March 26, 2021 of the Government, because the required deadline has passed but the investor still has not supplemented the dossier.

There are 3 dossiers in which the Provincial People's Committee has issued decisions approving the investment policy and adjusting the investment policy. There are 4 dossiers in which the Department of Planning and Investment has issued a document summarizing and reporting to the Provincial People's Committee. There are 3 dossiers in which the investor has issued a document withdrawing the dossier. There are 6 dossiers in which the investor has resubmitted the revised and supplemented dossier according to the opinions of the departments, branches and localities.

By early March 2023, there were 57 pending applications (including 53 applications received in 2022 and 4 applications received in 2023). Of these, 32 applications were pending due to the investor's responsibility during the appraisal process, which required the departments and branches to supplement and adjust, but the investor had not supplemented as requested.

For example, the Ke But 3 marble mining project dossier in Giai Xuan and Tan Xuan communes, Tan Ky district, the investor Son Ngoc Phat Mineral Joint Stock Company submitted on July 1, 2022. Up to now, the investor and the People's Committee of Tan Ky district have not supplemented the contents according to the opinion of the Department of Construction. Or the Believe General Commercial Service Area project dossier in Hung Nguyen town is still behind schedule because the investor, Believe Company Limited, has not supplemented the contents related to the investment capital rate...

In addition to the reason that investors have not yet or are in the process of supplementing information, the responsibility for supplementing documents belongs to departments, branches and localities. Specifically: Department of Construction 2 documents; Department of Natural Resources and Environment 2 documents; Department of Finance 1 document; Department of Transport 2 documents; Department of Industry and Trade 1 document; Fire Police of the Provincial Public Security 1 document.

The responsibility for providing additional information belongs to the following localities: Dien Chau (5 records), Do Luong (2 records), Nam Dan (3 records), Nghi Loc (4 records), Quy Hop (2 records), Quynh Luu (2 records), Hoang Mai town (1 record), Vinh city (1 record), Con Cuong (1 record), Cua Lo town (1 record).

Urge to supplement and resolve thoroughly

On March 13, 2023, the Provincial People's Committee issued Official Dispatch No. 1682/UBND-CN on the implementation of investment projects in the area to provincial departments, branches and sectors and district People's Committees.

Based on the report of the Department of Planning and Investment on 83 dossiers of overdue non-budget investment projects that have not been resolved in the province, the Provincial People's Committee requested all levels and sectors to resolve them thoroughly to ensure timely and effective implementation of investment projects, improve the investment and business environment, and promote socio-economic development of Nghe An province.

Specifically, the Provincial People's Committee agrees with the report of the Department of Planning and Investment in Official Dispatch No. 822/SKHDT-DN dated March 8, 2023, assigning the Department of Planning and Investment to continue urging relevant departments, branches, localities and units to urgently provide advice on investment projects in the province.

Clarify the causes, have solutions to remove and resolve projects facing difficulties and problems. In case any project is not feasible, summarize and report to remove it from the list of pending records according to regulations.

Assign relevant departments, branches, localities and units to seriously carry out the tasks stated in Official Dispatch No. 822/SKHĐT-DN dated March 8, 2023 of the Department of Planning and Investment and the attached list. Proactively coordinate and send written reports to the Department of Planning and Investment for synthesis, reporting to the Provincial People's Committee to advise on removing obstacles and supporting solutions.

The report of the Department of Planning and Investment also said that every month, the department reviews dossiers that do not have enough opinions from relevant departments, branches, localities and units; issues documents urging units to process and resolve dossiers for investors and synthesizes and reports to the Administrative Procedure Control Department - Office of the Provincial People's Committee on the implementation status.

For the 57 pending dossiers, the Department of Planning and Investment will compile a list of projects and notify each investor to urge them to make corrections and additions within 10 working days from the date of notification. In case the investor fails to make corrections and additions within the required time limit, the Department of Planning and Investment will notify the investor in writing of the suspension of dossier processing in accordance with Clause 1, Article 6, Decree 31/2021/ND-CP dated March 26, 2021 of the Government detailing and guiding the implementation of a number of articles of the Investment Law.

For the remaining files, the Department of Planning and Investment will continue to send documents urging agencies and units that have not yet commented to promptly provide written comments. In case any project is feasible but is facing difficulties and obstacles, the Department of Planning and Investment will continue to coordinate with departments, branches and localities to clarify the causes and have solutions to remove and resolve them. In case any project is not feasible, it will be compiled and removed from the list of pending files.
