Judgment of the Panel of Judges
Defendant Dinh Ngoc He did not admit to the crime. However, the other defendants admitted to the crime. The testimonies of these defendants and related parties indicate that the prosecution of defendant He is well-founded.
Hệ's practice of renting and mortgaging cars also led to complaints, affecting the reputation of the military.
There is sufficient basis to determine that the defendants abused their positions and authority while performing their official duties. The prosecution's indictment of the defendants is well-founded, targeting the right people, the right crimes, and in accordance with the law. The defense arguments of defendant Hệ's lawyers are not accepted.
The defendant Hệ also used forged documents to file applications and make appointments in violation of regulations. At the trial, the defendant admitted his actions.
Defendant Tham, while managing military personnel under her command, neglected her duties, leading to a lack of control over Thai Son Company and the actions of Dinh Ngoc He. This allowed He to provide vehicles to relatives and acquaintances, and enabled military personnel He to create contracts for the delivery of counterfeit gasoline to avoid penalties for substandard fuel. Defendant Tham's actions constitute the crime of Negligence Causing Serious Consequences.
Defendant Hệ must bear responsibility due to the aggravating circumstance of committing two or more crimes. We recommend that the competent authority revoke all medals and awards previously bestowed upon defendant Hệ.
The other defendants had no aggravating circumstances. The court also considered mitigating circumstances for the defendants.
The court affirmed that the defendants' actions caused losses exceeding 1.4 billion VND, seriously damaging the reputation of the military and the State, and therefore required strict punishment.
Regarding defendant Tham, the panel of judges found the nature of her crime to be serious, but noted that she had many achievements and contributions, was a first-time offender, and had a clear place of residence... therefore, she did not need to be isolated from society.
