Central Inspection Committee concludes on Mobifone's purchase of AVG

The Central Inspection Committee has reviewed and concluded on violations in the management, direction and implementation of the Mobifone project to buy shares of AVG company.

On June 2, the Central Inspection Commission issued a notice on the 26th Session.

From May 28 to 30, 2018, in Hanoi, the Central Inspection Commission held its 26th meeting. Comrade Tran Cam Tu, Secretary of the Party Central Committee, Chairman of the Central Inspection Commission chaired the meeting.

At this session, the Central Inspection Commission reviewed and concluded the following contents:

I-Inspect when there are signs of violations by the Party Committee of the Ministry of Information and Communications in leading, directing and organizing the implementation of the Project of Mobifone Telecommunications Corporation purchasing 95% of shares of AVG Global Audiovisual Joint Stock Company (The Government Inspectorate has issued Inspection Conclusion No. 355/KL-TTCP, dated March 14, 2018). The inspection shows that:

1- The Party Executive Committee of the Ministry of Information and Communications has not strictly implemented the principles of organizing party activities, violated the principles of democratic centralism and working regulations; lacked responsibility, loosened leadership, direction, inspection and supervision, allowing the Ministry of Information and Communications and Mobifone Corporation to seriously violate legal regulations in appraising, approving and organizing project implementation, causing great loss of state assets; failed to promptly lead and direct the strict implementation of the Government Inspectorate's conclusion on the above project.

2- Comrade Nguyen Bac Son, former member of the Party Central Committee, former Secretary of the Party Executive Committee, former Minister of Information and Communications, is primarily responsible for the violations and shortcomings of the Party Executive Committee for the 2011-2016 term. He violated the principle of democratic centralism and working regulations; showed signs of imposition and lack of democracy in leadership and direction; did not discuss within the Party Executive Committee; directly directed and decided on many contents related to the project in violation of regulations; signed documents to submit to the Prime Minister for approval of the project investment policy and assigned subordinates to sign a number of documents related to the project with contents contrary to regulations and not in accordance with assigned tasks; lacked direction and inspection of the project implementation process, allowing many violations to occur.

3- Comrade Truong Minh Tuan, Member of the Party Central Committee, Secretary of the Party Committee, Minister of Information and Communications.

- During his tenure as a member of the Party Executive Committee and Deputy Minister, he was jointly responsible for the violations and shortcomings of the Party Executive Committee for the 2011-2016 term. He violated the principles of democratic centralism and working regulations; lacked responsibility and slackened leadership during the process of being assigned to direct the implementation of the project; signed Decision No. 236/QD-BTTTT, dated December 21, 2015 of the Ministry of Information and Communications approving the project and a number of related documents contrary to regulations, some of which were not within the assigned tasks.

- As Secretary of the Party Committee and Minister from April 2016 to present, you are primarily responsible for the violations and shortcomings of the Party Committee for the 2016-2021 term.

4- Comrade Pham Hong Hai, member of the Party Executive Committee, Deputy Minister of Information and Communications, is jointly responsible for the violations and shortcomings of the Party Executive Committee for the 2011-2016 and 2016-2021 terms. He violated the principles of democratic centralism and working regulations; lacked responsibility, slackened leadership, management, inspection and supervision, allowing Mobifone Corporation to commit serious violations in project implementation; directly signed a number of documents related to the project with content contrary to regulations.

5- Comrade Pham Dinh Trong, Director of the Department of Enterprise Management, Ministry of Information and Communications, committed many very serious violations in advising the leaders of the Ministry of Information and Communications to lead, direct, and organize the implementation of the project.

Together with the above mentioned collectives and individuals, through inspection, the Central Inspection Committee concluded:

- The Standing Committee of the Party Committee of Mobifone Corporation violated the principle of democratic centralism and working regulations; loosened leadership and direction, lacked inspection and supervision, allowing Mobifone Corporation to commit many serious violations during the project implementation process.

- Comrade Le Nam Tra, former Party Secretary and Chairman of the Board of Members of Mobifone Corporation, committed many very serious violations and was primarily responsible for the Board of Members of the Corporation submitting the project to the Ministry of Information and Communications for approval and implementation; directly signed many documents related to the project in violation of regulations.

- Comrade Cao Duy Hai, Deputy Secretary of the Party Committee, Member of the Board of Members, General Director of Mobifone Corporation committed many serious violations in advising the Board of Members of the Corporation to submit to the Ministry of Information and Communications for approval and implementation of the project; directly signed many documents related to the project in violation of regulations.

The violations of the Party Executive Committee of the Ministry of Information and Communications, comrade Nguyen Bac Son, comrade Truong Minh Tuan, comrade Pham Dinh Trong, the Standing Committee of the Party Committee of Mobifone Corporation and comrades Le Nam Tra and Cao Duy Hai are very serious. The violations of comrade Pham Hong Hai are serious, causing great loss of State assets, negatively affecting the operations and equitization process of Mobifone Corporation, the reputation of the Party organization and the Ministry of Information and Communications, causing outrage in society, to the point of having to consider and take disciplinary action.

The Ministry of Planning and Investment, the Ministry of Finance, the Government Office, the Ministry of Public Security, and the People's Committee of Binh Duong Province are responsible for the violations and shortcomings in this project. The Central Inspection Commission requests the Party Executive Committee, Party Committee, and leaders of the above agencies to review and consider handling the responsibilities of relevant collectives and individuals, and report to the Politburo, the Secretariat, and the Central Inspection Commission.

II-Inspection when there were signs of violations against the Standing Committee of the Party Committee of the Joint Stock Commercial Bank for Investment and Development of Vietnam (BIDV), showed that:

1- The Standing Committee of the Party Committee of the Vietnam Joint Stock Commercial Bank for Investment and Development for the 2010-2015 and 2015-2020 terms violated the principle of democratic centralism; lacked responsibility, slackened leadership, direction, management, and lacked inspection and supervision, allowing the Vietnam Joint Stock Commercial Bank for Investment and Development to commit many serious and systematic violations in implementing working regulations, regulations on decentralization of authority, and credit granting processes and procedures, causing very serious consequences, increasing bad debts, especially debts with the possibility of losing capital; allowing many officials to violate party discipline and state laws and be criminally prosecuted; reducing budget revenue, affecting business results, income, jobs and lives of employees of the Vietnam Joint Stock Commercial Bank for Investment and Development.

2- Comrade Tran Bac Ha, former Party Secretary, former Chairman of the Board of Directors, is primarily responsible for the violations and shortcomings of the Party Committee Standing Committee for the 2010-2015 and 2015-2020 terms. He violated the principle of democratic centralism and working regulations, showed signs of imposition and lack of democracy in direction and management; violated the resolution of the Party Committee Standing Committee on the obligations and responsibilities of position holders in the system of the Joint Stock Commercial Bank for Investment and Development of Vietnam; violated the process, procedures, authority and regulations on credit in approving policies and deciding on a number of loans, guarantees, investments and debt management, including approving a loan policy of VND 4,700 billion for 12 companies related to the case at the Construction Bank.

3- Comrade Doan Anh Sang, former member of the Party Committee Standing Committee, Deputy General Director and Comrade Tran Luc Lang, member of the Party Committee Standing Committee, Deputy General Director of the Joint Stock Commercial Bank for Investment and Development of Vietnam, are jointly responsible for the violations and shortcomings of the Party Committee Standing Committee; jointly responsible for a number of loans, guarantees, investments, and debt management violations; and responsible for proposing and appraising the loan policy of VND 4,700 billion for 12 companies related to the case that occurred at the Construction Bank.

The violations of comrade Tran Bac Ha are very serious, the violations of the Standing Committee of the Party Committee of the Joint Stock Commercial Bank for Investment and Development of Vietnam for the 2010-2015, 2015-2020 terms and comrades Doan Anh Sang and Tran Luc Lang are serious, negatively affecting the reputation of the Party organization and the Joint Stock Commercial Bank for Investment and Development of Vietnam, causing outrage in society, to the point of having to consider and take disciplinary action.

Other comrades in the Standing Committee of the Party Committee of the Vietnam Joint Stock Commercial Bank for Investment and Development for the 2010-2015 and 2015-2020 terms are jointly responsible for the violations and shortcomings of the Standing Committee of the Party Committee and are directly responsible for the violations and shortcomings of individuals in performing their assigned duties and tasks, to the extent that they must review and propose disciplinary measures according to Party regulations.

The State Bank of Vietnam is responsible for the above violations and shortcomings of the Joint Stock Commercial Bank for Investment and Development of Vietnam. The Central Inspection Committee requests the Party Executive Committee of the State Bank of Vietnam to seriously review, learn from experience and direct the review of the responsibilities of organizations and individuals related to the violations and shortcomings of the Joint Stock Commercial Bank for Investment and Development of Vietnam; promptly review, amend and supplement regulations in the banking sector; strengthen inspection, examination and supervision of credit institutions.

III-The Central Inspection Commission has reviewed and concluded the inspection of the implementation of inspection, supervision and party discipline enforcement tasks for the Standing Committees of the Provincial Party Committees and the Provincial Party Committee Inspection Committees of Nam Dinh, Ninh Binh, Bac Lieu provinces, the Standing Committees of the Party Committees and the Party Committee Inspection Committees of the Central Agencies Bloc; and inspected party finances for the Standing Committee of the Phu Tho Provincial Party Committee.

The Central Inspection Commission pointed out the advantages, limitations, and shortcomings and requested Party committees and organizations at all levels to learn from experience and take timely remedial and corrective measures.

IV-Also at this session, the Central Inspection Commission considered and resolved 1 case of party disciplinary complaint under its authority; gave opinions on resolving 1 case of disciplinary complaint under the authority of the Secretariat; and gave opinions on the draft amendment and supplement to the Politburo's regulations on disciplinary action against violating party organizations./.
