The Government has just issued Decree 64/2018/ND-CP regulating administrative sanctions for violations in the field of livestock breeds, animal feed, and aquatic products, in which administrative violations in the field of animal feed and aquatic products will be fined up to 200 million VND.

This Decree provides for violations, forms of sanctions, levels of sanctions, remedial measures for administrative violations, authority to sanction and authority to draw up records of administrative violations in the field of livestock breeds (including aquatic breeds), animal feed, and aquatic products.

Administrative violations in the field of animal breeds, animal feed and aquatic products prescribed in this Decree include: Violations of regulations under Decree 39/2017/ND-CP on management of animal feed and aquatic products, including violations in production and processing of animal feed and aquatic products; purchase and sale of animal feed and aquatic products; import of animal feed and aquatic products; testing of animal feed and aquatic products; production, processing, purchase and sale, import of expired animal feed and aquatic products; use of antibiotics and banned substances in production, purchase and sale, import of animal feed and aquatic products; use of banned substances in animal husbandry and aquaculture; violations of regulations on management and conservation of animal genetic resources; exploitation and conservation of rare animal genetic resources; testing and inspection of new animal breeds; production, trading, export and import of animal breeds; management of animal breed quality.

Other administrative violations in the field of livestock breeds, animal feed, and aquatic products not specified in this Decree shall be subject to the provisions of other Government decrees on administrative sanctions in relevant state management fields.

The statute of limitations for handling administrative violations in the field of livestock breeds, animal feed, and aquatic products is 1 year, except for administrative violations in the production, trading, import, and export of livestock breeds, animal feed, and aquatic products, for which the statute of limitations for handling administrative violations is 2 years.

For each administrative violation in the field of livestock breeds, animal feed, and aquatic products, organizations and individuals must receive the main form of punishment, which is a warning or a fine.

The maximum fine for an administrative violation in the field of livestock breeds for an individual violator is 50 million VND, for an organization violator is 100 million VND. The maximum fine for an administrative violation in the field of animal feed and aquatic products for an individual violator is 100 million VND, for an organization violator is 200 million VND.

Decree 64/2018/ND-CP takes effect from June 22, 2018. This Decree replaces Decree No. 119/2013/ND-CP dated October 9, 2013 of the Government stipulating administrative sanctions for violations in the fields of veterinary medicine, animal breeds, and animal feed; the contents on administrative sanctions for violations in the fields of animal breeds, animal feed, and aquatic feed in Decree No. 41/2017/ND-CP dated April 5, 2017 of the Government amending and supplementing a number of articles of the decrees on administrative sanctions for violations in aquaculture activities; veterinary medicine, animal breeds, and animal feed; forest management, forest development, forest protection, and forest product management.
