Repeated fire safety violations: No additional records will be added, penalties will be increased.
A petroleum business has been repeatedly found to be improperly storing and arranging flammable and explosive goods. All violations involved the same act within the same establishment. From April 20, 2026, what penalties will be imposed in this case? Will a violation be documented and fined for each individual violation?

From April 20, 2026, according to Decree 69/2026/ND-CP, in cases of repeated violations of the same act at the same facility subject to fire safety management, each violation will no longer be subject to separate penalties.
This regulation is added in Clause 1, Article 2 of Decree 69/2026/ND-CP, amending and supplementing Article 3 of Decree 106/2025/ND-CP.
Accordingly, the authorities will only issue a single penalty for the violation, but apply aggravating circumstances due to repeat offenses. In other words, the penalties will not be "accumulated," but the fine will be increased within the prescribed range.
Specifically, Article 14 of Decree 106/2025/ND-CP stipulates the following penalties for violations in the management, storage, and use of flammable and explosive hazardous goods:
- Improper arrangement and storage: 3-5 million VND
- Improper storage or use: 5 – 10 million VND
- Creating a hazardous environment prone to fire and explosion: 10-15 million VND
- Illegally possessed: 20 – 25 million VND
- Unauthorized use: 45 – 50 million VND
In cases of repeated violations, the penalty will be increased within the prescribed range. If a fire occurs (but not to the extent of criminal prosecution), the penalty may be doubled.
In addition to fines, violating organizations and individuals may also be subject to supplementary measures such as confiscation of goods, forced removal or reduction of the quantity of hazardous goods, and remediation of fire safety conditions.
Note:Repeated fire safety violations may not result in multiple penalties, but each subsequent violation leads to significantly harsher penalties.
