Why have 16 planning areas in Nghe An not been auctioned?

According to information from the Nghe An Provincial Land Fund Development Center, due to the regulations of the 2024 Land Law, 16 planning areas for auction to exploit land funds according to the province's plan in 2025 cannot be implemented.

Previously, since February 2025, the Provincial People's Committee has approved and assigned the Provincial Land Fund Development Center to prepare procedures to auction 16 planning areas with a total area of ​​52.74 hectares from the first quarter to the fourth quarter of 2025. To implement the above plan, the Land Fund Development Center has implemented the procedural steps according to regulations.

Of the 16 planning areas planned for auction, the planning area with the largest area is the land in Block 5, Ben Thuy Ward, Vinh City (old), now Truong Vinh Ward, with an area of ​​64,344.18 m2.2; next is the land in Quynh Thien ward, Hoang Mai town (old), now Hoang Mai ward, area 21,182.6 m2; land in Quynh Bang commune, area 21,400 m2and Minh Luong commune of Quynh Luu district (old) has an area of ​​12,732.8 m2(These two communes are now merged into Quynh Anh commune); Planning area in Phuc Tho commune (now Vinh Loc ward) 12,358 m2.

The remaining planning areas include Cua Lo ward with 2 areas; the communes: Nghia Hanh, Lam Thanh, Quy Hop, Anh Son, Quynh Phu, Tan Ky, Tan Phu and Bach Ngoc each have 1 area.

According to the Provincial Land Fund Development Center, the reason why the above 16 land plots cannot be auctioned is because Clause 1, Article 125 of the Land Law stipulates: The State allocates land with land use fees, and leases land with one-time payment for the entire lease term through auctioning land use rights.

The above 16 land plots originated as commercial service or agricultural production land, now being recovered by the State and put up for auction for organizations and individuals to use for commercial service or agricultural production; in case of conversion to other purposes, it is necessary to conduct an auction of land use rights or bid to select investors to implement projects using land and pay a one-time fee according to regulations.

With such regulations, many organizations, businesses and individuals who need to use land find it difficult to access because they do not have enough money to pay at once.

Mr. Cao Quang Trung - Director of the Provincial Land Fund Development Center added: In addition to the above reasons, many land plots planned for auction originate from land recovered due to project delays or expired leases that were not extended; some places on the land still have assets of enterprises, even households living there. Typically, the 702.7 m² land plot at location No. 1, Nghia Dung commune (now Tan Ky commune) and the 519 m² land plot in Anh Son commune. Therefore, the mobilization and clearance work encountered many difficulties, and the site clearance to hand over clean land could not be completed.

The center has reported to the leaders of the Department and the Provincial People's Committee, and at the same time, proposed that the Provincial People's Committee issue new regulations on land use rights auctions to replace the old Decision from 2018 that has expired.
