The working group of the Supreme People's Procuracy concluded that the owner of Xin Chao coffee shop did not commit a crime and requested the leaders of the Ho Chi Minh City People's Procuracy to suspend the related officials.

On April 23, Chief Justice of the Supreme People's Procuracy Le Minh Tri worked with leaders of the Ho Chi Minh City People's Procuracy and Binh Chanh District on the case of Mr. Nguyen Van Tan - owner of Xin Chao Coffee Shop - accused of illegal business.

After listening to the leaders of the Ho Chi Minh City People's Procuracy and Binh Chanh District report on the content and process of handling the case, Mr. Tri said that Mr. Tan did not commit the crime of Illegal Business according to Article 159 of the Penal Code.

Mr. Tri also requested the Chief Prosecutor of the Ho Chi Minh City People's Procuracy to direct the Chief Prosecutor of the Binh Chanh District People's Procuracy to immediately issue a decision to suspend the case and suspend the defendant against Mr. Tan. At the same time, publicly apologize and compensate Mr. Tan for damages (if any) according to regulations.

Mr. Le Minh Tri also assigned the Head of the Department of Prosecution and Investigation of Economic Cases of the Supreme People's Procuracy to announce lessons learned throughout the entire prosecution sector regarding the shortcomings and violations in the above case.

On August 18, 2015, Mr. Tan was fined by the Binh Chanh District Police for administrative violations of the act of trading in coffee, breakfast... without being granted a business registration certificate according to the provisions of law.

After being fined, on September 10, 2015, Binh Chanh District Police discovered that Mr. Tan continued to illegally trade in coffee, soft drinks... without being granted a certificate of food hygiene and safety. Mr. Tan was thenprosecuted for illegal business

As the case was about to go to trial,On April 19, Secretary of the City Party Committee Dinh La Thang requested the Ho Chi Minh City People's Committee to direct the Ho Chi Minh City Police and People's Procuracy to investigate the case.

A day later, Prime Minister Nguyen Xuan Phuc directed the Ho Chi Minh City People's Committee to review the criminal handling of Mr. Tan.

On the morning of April 21, Ho Chi Minh City Police held a press conference, confirming that the criminal prosecution of Mr. Tan was well-founded but hasty. At the same time, Binh Chanh District People's Court returned the case file for further investigation.
