Vietnam has its first Family and Juvenile Court

In order to ensure human rights in line with world trends, the Ho Chi Minh City People's Court will launch the Family and Juvenile Court in April.

On March 18, Politburo member and Chief Justice of the Supreme People's Court Truong Hoa Binh said that the Family and Juvenile Court under the Ho Chi Minh City People's Court is expected to launch on April 3. The city needs to prepare all conditions to ensure the operation of this specialized court. The Ho Chi Minh City People's Court is the first unit in the country to pilot the operation of this court.

According to the Chief Justice of the Supreme People's Court, the organization of specialized courts at provincial and district-level People's Courts according to the provisions of the 2014 Law on Organization of People's Courts must be based on the actual trial practice of each court; depending on the team of judges, examiners, and secretaries of each court, the proposal will be submitted to the Chief Justice of the Supreme People's Court for consideration and decision.

Also at the online conference summarizing judicial reform work in the People's Court and implementing the Supreme People's Court's guidance on establishing specialized courts, Mr. Chu Thanh Quang - Deputy of the Supreme People's Court's Legal Affairs and Science Management Department - said that this is a newly established specialized court to protect and develop Vietnamese families.

Specifically, protecting, caring for, educating children in general and handling juvenile offenders; Implementing Vietnam's international commitments on protecting children's rights. This is also one of the important milestones of judicial reform and innovation in the operation of the People's Court.

According to Mr. Quang, the Family and Juvenile Court is expected to be a child-friendly court, effectively and reasonably resolving family and marriage cases.

Chief Justice of the Ho Chi Minh City People's Court Ung Thi Xuan Huong said that the unit has fully prepared the facilities and human resources for the launch of this specialized court. After the pilot, it will be expanded to district and county courts.

Regarding the reform of judicial administrative procedures at court, Chief Justice Huong added that the Ho Chi Minh City People's Court has applied information technology software to receive, manage, and control the settlement of cases from input to output settlement results. Therefore, the software will detect errors such as: overdue work settlement, wrong authority, violations... so that leaders can remind and urge settlement.

After a period of applying this model, all received files, procedural documents, and issued judgments are barcoded; the delay in transferring files, judgments, decisions, notices of acceptance, and detention orders is overcome; the work of receiving and handling appeals, protests, and complaints is resolved quickly and promptly.

According to the Law on Organization of People's Courts 2014, the structure of People's Courts of provinces and centrally run cities includes Criminal, Civil, Administrative, Economic, Labor courts and Family and Juvenile Courts. People's Courts of districts, towns and provincial cities include Criminal, Civil, Family and Juvenile Courts and Administrative Courts. However, to date, Family and Juvenile Courts have only been put into pilot.
