'The Da River water pipeline burst, the responsibility is not just one individual'

The Deputy Head of the Central Committee for Mass Mobilization said that the responsibility related to the rupture of the Da River water pipeline does not only belong to Mr. Phi Thai Binh.

Regarding the decision by the Ministry of Public Security's investigation police agency to prosecute Mr. Phi Thai Binh, former Vice Chairman of the Hanoi People's Committee, for violations related to the recent Da River water pipe burst, on the sidelines of the National Assembly, discussing the draft Law amending and supplementing a number of articles of the Penal Code No. 100/2015/QH13, Mr. Thao Xuan Sung, member of the Party Central Committee, Deputy Head of the Central Mass Mobilization Commission, said that the investigation police agency's prosecution was correct.

PV:What do you think about the investigation agency's decision to prosecute Mr. Phi Thai Binh - former Vice Chairman of Hanoi People's Committee?

Mr. Thao Xuan Sung:I have been following the case from the beginning and believe that the prosecution of the case is correct, but the responsibility is not only on one individual. The prosecution of the former Vice Chairman of the Hanoi People's Committee is related to the responsibility of the leader only. The violations in the Da River water pipeline are related to the organization and unit assigned to carry out the task.

Thus, not only in terms of specific practice but also whether the policy and solution are correct or not, it is related to decisions, and decisions are always the principle of collective leadership and individual responsibility.

PV:But the Procuracy has not approved it yet, sir?

Mr. Thao Xuan Sung:I think it's prudent. And the police recommended approval, which I agree with. Prosecution does not mean guilt.

Hanoi people really need clean water, the pipes have broken many times and cannot be fixed, so responsibility from policy to implementation must be considered, not just Mr. Phi Thai Binh.

This is also an opportunity for the Party Committee and the government to thoroughly consider this project and draw profound lessons from implementing major projects related to national livelihoods and the people.

PV:Many recent incidents have shown that the responsibility of leaders and the handling of violations by leaders have been emphasized. What is the significance of this, sir?

Mr. Thao Xuan Sung:I strongly agree with the policy of the Central Committee, the Politburo, the Secretariat, especially the opinion of the General Secretary in clarifying the responsibility of the head in leadership, direction and management.

A leader is a person who is fully prepared in terms of moral qualities, professional capacity and necessary qualities to lead a group. Letting an incident like the Da River water pipeline happen means that he has not performed his assigned tasks properly, so reviewing and assigning responsibility to the leader is completely correct and accurate, and there is nothing too harsh.

Assigning responsibility to leaders in the coming time will encourage party committees and organizations at all levels to focus on leadership, and state agencies and mass fronts to perfect legal documents, regulations, and procedures for implementing the responsibilities, functions, and tasks of leaders.

Delegate Nguyen Van Chien (Chairman of the Hanoi Bar Association) said that for wrongful acts that cause damage to society, it is necessary to consider the nature and extent of that act to handle it according to the criminal nature of the law. Therefore, anyone who commits an act that is harmful to society must be considered and handled according to the provisions of the law.

Mr. Chien also stated that when the investigation agency has considered and fully determined the elements that constitute a criminal offense and initiated prosecution, the prosecution agency also needs to consider the investigation agency's request.

In response to the information that Mr. Phi Thai Binh said he was not guilty, this delegate also said that according to the law, when a person is considered for criminal responsibility like Mr. Phi Thai Binh, they have the right to defend themselves and ask others to defend them. The 2015 Criminal Procedure Code also stipulates that they have the right not to accept their criminal responsibility and not to testify against them.

Therefore, of course, when the competent authority conducts proceedings to consider responsibility, the suspect and prosecuted person like Mr. Phi Thai Binh has the right to affirm that he has not committed any wrongdoing./.
