Wife begged the court not to prosecute her husband
Although representing the victim, Ms. Chinh persistently begged the panel of judges to change the charges against the husband who beat his son to death and buried his body in the house.
On August 16, the People's Court of Dong Nai province held the first instance trial of Nguyen Minh Tam (34 years old, residing in Bien Hoa city) for murder. Nearly a year ago, he beat his 5-year-old son to death and buried his body in his house in Trang Dai ward, Bien Hoa city.

According to the indictment, Tam and Ms. Nguyen Thi Chinh (42 years old) did not register their marriage but lived together as husband and wife since 2008. They have 4 children together, of which the eldest granddaughter was sent to Ha Tinh to be raised by her grandmother.
On September 7, 2015, Tam brought his new girlfriend home to live with him, causing a conflict between the couple. Because her husband often abused her, Chinh took her 2-year-old child and rented a room outside, leaving the other two children to live with Tam.
On the afternoon of September 15, 2015, Tam had dinner with her two children in the living room. Because she missed her mother, Thang (5 years old) cried and refused to eat. Tam got angry and kicked Thang against the wall, falling face down on the ground. After being beaten by her father, the child got up and went to the bedroom.
The next morning, Tam went into the room to wake his son up and discovered that he was dead. Afraid that his family and neighbors would find out, the father borrowed tools to dig a hole and bury his son's body right in the house.
A week after smelling an unusual smell coming from Tam’s house, many people reported Thang’s disappearance to the police. After a struggle, the man admitted to killing his son.

At the trial, both Tam and the defense attorney argued that the prosecution's prosecution of the murder charge was not consistent with the nature of the case because the defendant had no motive to kill, only beat the child but accidentally killed the child.
Although representing the victim, the wife also begged the jury to change the charges against her husband to reduce the sentence so that he could return home to raise his three children. Meanwhile, the representative of the Procuracy still maintained the viewpoint of "prosecuting the right person for the right crime", claiming that Tam had caused the death of her child and then concealed the crime.
After the debate, the panel of judges found that the case file had serious procedural errors during the investigation, so they decided to return the file for reinvestigation.
