Wife jailed for 7 years for having 'sex' with... husband

Prosecutors have sentenced a woman to seven years in prison for forcing her husband to have sex.

In a rare case that has occurred for the first time in the history of South Korean justice, Shim, 41, was brought to trial at the Seoul Central District Court after holding her husband captive for 29 hours in their apartment in Jongno-gu, Seoul, in May 2015, according to the indictment.

With the help of an accomplice, Shim restrained and bound the victim’s legs with duct tape. Not only that, this woman repeatedly forced her husband to have sex during that time of detention.

Confessing to the police, the victim said that the couple were at that time suing each other regarding divorce proceedings.

The victim was coerced by his wife into saying that the reason he sought a divorce was because he had an affair and wanted to end the marriage so he could openly reveal his new love. Shim recorded this false confession and used it as evidence against her husband in court.

The poor man was rescued after he managed to make a phone call. “She was so scary. It was a terrible time for me,” said the husband.

At the police station, Shim admitted to locking the victim up, tying him up, and beating him with a hammer, but denied any charges of sexual assault. The woman insisted that she never had any such intention, and that the sexual act between the two was voluntary and consensual.

“Although there are many things I want to say, in the end, I just ask the court to give a fair and just verdict,” she said.

After receiving the case and conducting an investigation, prosecutors confirmed that Shim's actions were real and her purpose was to gain an advantage while conducting divorce proceedings between the two.

“The defendant has shown no remorse for her actions and has not received forgiveness from her husband, who is also her victim, and therefore a severe punishment is inevitable,” the prosecutor argued.

Previously, in May 2013, the Supreme Court of South Korea passed a law recognizing “marital rape” as a crime and subject to prosecution. Accordingly, Shim became the first woman in South Korea to be convicted of raping her husband.

Another accomplice, Kim (42), who helped Shim detain the victim, was also recommended a three-year prison sentence. The sentence took effect from September 9, 2016.
