(Baonghean.vn) - My nephew has been working for 2 months but is still studying for a Master's degree at his old school. Once, he borrowed a Honda SH from a colleague to go back to school. In a hurry, he did not lock the bike and a thief stole it. He accidentally caused serious damage to his friend's property. What should be done?

Reply:According to Article 180 of the 2015 Penal Code and the Law amending and supplementing a number of articles of the 2017 Penal Code, the crime of unintentionally causing serious damage to property will be subject to the following criminal sanctions:

1. Anyone who unintentionally causes damage to another person's property worth from VND 100,000,000 to under VND 500,000,000 shall be subject to a warning or non-custodial reform for up to 02 years.

2. Committing a crime that causes damage to another person's property worth VND 500,000,000 or more shall be punishable by imprisonment from 03 months to 02 years.

Involuntary damage to property is understood as an act of carelessness or overconfidence that causes damage to another person's property. Your niece has graduated from university and is old enough to be held criminally responsible. If the SH motorbike is worth up to 100 million VND, she will be given a warning or sentenced to non-custodial reform for up to 02 years. If the property is worth 500 million VND or more, she will be imprisoned from 03 months to 02 years.
