The case of losing 50 billion at Nghe An bank: Customer refused the advance payment
A customer who lost 28 billion in the case of 50 billion "evaporating" at Eximbank Nghe An said he was insulted when the bank offered to advance 1.55 billion while waiting for the court's results.
Mr. Nguyen Tien Nam is one of 6 people who deposited money at Eximbank Do Luong Transaction Office (Nghe An), related to the case of female cashier Nguyen Thi Lam embezzling more than 50 billion VND in savings books. Mr. Nam deposited 13 savings books with more than 28 billion VND, but Lam withdrew more than 27.8 billion VND, leaving only more than 195.9 million VND in 2016.
On March 12, he was one of the six customers mentioned above who authorized a lawyer to go to Eximbank Headquarters to work to request that the bank resolve the issue of closing the savings book before the court tries the case of "Fraudulent appropriation of property" next April.

At this meeting, the bank promised to respond in writing within the week, but on March 20, an Eximbank representative came to work directly with Mr. Nam and a lawyer in Do Luong and proposed to advance Mr. Nam an amount of 1.55 billion VND, along with terms prepared by Eximbank, the remaining amount must await the court's decision.
In response to this request, Mr. Nam did not agree and said that there was already a conclusion from the investigation agency, and here he did not have to ask or the bank did charity, but this was his money deposited so there was no need to sympathize with his situation and give him an advance.
According to Mr. Nam, the proposal to advance 1.55 billion VND is "an insult from Eximbank to him". On the other hand, this indirectly suspects that the customer colluded with his staff to appropriate Eximbank's money when he did not believe in the investigation results of the police agency, although the bank did not appeal that conclusion.
This customer further analyzed that the upcoming court trial is to try the criminal acts of 16 Eximbank officials who committed the crimes of “Fraudulent appropriation of property” and “Intentionally violating economic management regulations causing serious consequences”, the property that was appropriated belongs to Eximbank. In terms of criminal matters, the court will impose specific sentences on the defendants, in terms of civil matters, the court will decide how much compensation the defendants must pay to Eximbank.
"Therefore, I have no reason, in other words, there is no regulation requiring me to wait for the court's decision before being allowed to bring my savings book to Eximbank to withdraw money," he emphasized and said.did not accept the bank's request for an advance payment but continued to request Eximbank to pay 28 billion before the Court's trial.
In Eximbank's latest dispatch responding to Mr. Nam on March 23, the bank continued to express its view that the Investigation Agency has issued an investigation conclusion, the People's Procuracy of Nghe An province has issued an indictment and the Court is still in the process of reviewing and resolving the case, and no legally effective verdict has yet been issued.
Therefore, Eximbank believes that all opinions stated in the investigation conclusion or indictment are only opinions from the Investigation Agency or the People's Procuracy of Nghe An province, not the final decision and have legal effect to be implemented. Therefore, Mr. Nam's opinions requesting Eximbank to immediately pay, Eximbank cannot implement.
On the other hand, the bank said that not appealing against the Investigation Conclusion and the indictment does not mean that Eximbank has agreed with these documents. The bank said that it must wait for the Court's effective judgment.
Previously, the Investigation Police Agency of Nghe An Province Police requested Eximbank to resolve the requests of 6 customers who deposited savings and forced Nguyen Thi Lam to compensate for the entire amount of money she had appropriated from Eximbank. In addition, the Indictment No. 34 dated February 8, 2018 of the People's Procuracy of Nghe An Province continued to confirm the above information.
In addition to the above case of the loss of 50 billion VND, related to the case of Ms. Chu Thi Binh losing 245 billion VND in her savings book at Eximbank, this bank also proposed to advance Ms. Binh more than 14.8 billion VND - the amount on the payment authorization paper that the Investigation Police Agency - Ministry of Public Security (C44) determined that the signatures of the account owner and the authorized person were forged. As for the other amounts, the bank will wait for court.
That day, Ms. Binh said she would reconsider accepting the advance payment but would have to review the draft of the agreement before deciding whether to agree or not.
However, after consideration, Ms. Chu Thi Binh refused to accept the advance payment. Talking withVnExpressOn March 2, Ms. Binh said that when working with Eximbank, she and the bank could not find consensus on the terms. The bank did not explain clearly, only said in general that the money would support her to solve her difficulties while her lost amount was not mentioned.
"The bank even put forth a confidentiality clause to maintain the bank's reputation, so I did not accept it. I asked for my money transparently, so why should it be confidential?", Ms. Binh said.
Up to now, Eximbank has not had any new solution for Ms. Binh.
