According to the lawyer, Vu "nhom" has fled abroad so the possibility of being released on bail during the investigation, prosecution, and trial is impossible.

On December 21, 2017, the Ministry of Public Security's Security Investigation Agency issued a wanted notice for Phan Van Anh Vu (also known as Vu "Nhom"). While on the run, Phan Van Anh Vu violated Singapore's Immigration Law and was deported.

Mr. Vu "aluminum" has been extradited to Vietnam.

On January 4, the Ministry of Public Security's Security Investigation Agency received Phan Van Anh Vu to conduct an investigation according to legal regulations.

Talking to reporters about this incident, lawyer Dang Xuan Cuong (Hanoi Bar Association) analyzed: Mr. Vu knew he was being prosecuted for intentionally revealing state secrets and fled, causing the investigation process to be interrupted.

Like other criminal cases, when arrested and brought back to Vietnam, Vu "nhom" will be immediately detained to serve the investigation process. The case will go through the investigation, prosecution, trial and execution processes. Vu "nhom" has fled abroad, so the possibility of being released on bail during the investigation, prosecution and trial is impossible.

During the investigation of the case, if other crimes are discovered, the Ministry of Public Security's Security Investigation Agency will initiate additional prosecution.

The arrest and investigation of Vu "Nhom" will answer questions raised by public opinion such as: What secrets did Vu "Nhom" reveal? Who reported that Vu was being investigated and prosecuted, allowing the defendant to escape?...

Regarding the information that Mr. Phan Van Anh Vu has up to 3 passports, Lawyer Cuong said that "global intelligence activities and the use of fake passports are not rare".

According to the provisions of Article 337 of the Penal Code 2015 (effective from January 1, 2018), amended by Clause 125, Article 1 of the Law amending the Penal Code 2017:

1. Anyone who intentionally discloses state secrets, appropriates, buys, sells or destroys state secret objects or documents, if not in the cases specified in Article 110 of this Code, shall be sentenced to imprisonment from 02 to 07 years.

2. Committing a crime in one of the following cases shall be punishable by imprisonment from 05 years to 10 years:

a) State secrets of top secret level.

b) Abuse of position and power.

c) Causing damage to national defense, security, foreign affairs, economy and culture.

3. Committing a crime in one of the following cases shall be punishable by imprisonment from 10 to 15 years:

a) Organized.

b) State secrets are top secret.

c) Committing the crime 2 times or more.

d) Causing damage to the political regime, independence, sovereignty, unity and territorial integrity.

Offenders may also be fined from VND 10,000,000 to VND 100,000,000, banned from holding positions, practicing a profession or doing certain jobs from 01 to 05 years./.
