On the morning of April 23, a working delegation of the Supreme People's Procuracy led by Mr. Le Minh Tri - Member of the Party Central Committee, Chief Justice of the Supreme People's Procuracy - went to Ho Chi Minh City to work with the leaders of the Ho Chi Minh City People's Procuracy and the Binh Chanh District People's Procuracy on the case of Mr. Nguyen Van Tan - owner of Xin Chao coffee shop.

The working delegation listened to the leaders of the Ho Chi Minh City People's Procuracy and Binh Chanh District People's Procuracy report on the entire content and process of handling the illegal business case that occurred in Binh Chanh District, where Mr. Nguyen Van Tan was prosecuted for illegal business.

Based on the opinions of the heads of units under the Supreme People's Procuracy and the Deputy Chief Procurators of the Supreme People's Procuracy, Mr. Tri directed the following contents:

Firstly, Mr. Nguyen Van Tan did not commit the crime of Illegal Business under Article 159 of the Penal Code.

The Chief Justice of the Supreme People's Procuracy requested the Chief Justice of the Ho Chi Minh City People's Procuracy to direct the Chief Justice of the Binh Chanh District People's Procuracy to immediately issue a decision to suspend the case and suspend the defendant against Mr. Nguyen Van Tan according to Clause 2, Article 107 and Clause 1, Article 169 of the Criminal Procedure Code, and at the same time publicly apologize and compensate for damages (if any) to Mr. Nguyen Van Tan according to the provisions of law.

Second, the Chief Justice of the Supreme People's Procuracy requested the Chief Justice of the Ho Chi Minh City People's Procuracy to temporarily suspend the prosecutor and the leader of the Binh Chanh District People's Procuracy who directly conducted the proceedings for review and clarification according to the provisions of law.

At the same time, through this case, the Chief Justice of the Ho Chi Minh City People's Procuracy synthesized violations and shortcomings in handling administrative violations in the above case to recommend to the Ho Chi Minh City People's Committee to take measures to remedy and prevent violations of the law.

The Head of the Department of Prosecution and Investigation of Economic Cases shall issue a notice to draw lessons for the entire prosecution sector regarding shortcomings and violations in the prosecution process of the above case.

Upon receiving this notice, the heads of units under the Supreme People's Procuracy, the Chief Prosecutor of the Ho Chi Minh City People's Procuracy, and the Chief Prosecutor of Binh Chanh District People's Procuracy are requested to seriously implement this conclusion.

The content of this working session was also reported to the Prime Minister.

Speaking to reporters, Lieutenant General Le Dong Phong - Director of Ho Chi Minh City Police - said that as soon as the Binh Chanh District People's Procuracy decides to suspend this case, it will immediately organize a review and find solutions for personnel organization.

However, according to Mr. Phong, Ho Chi Minh City police only have the authority to recommend and decide on the form of handling for the Director General of the General Department of Politics of the Ministry of Public Security to make a decision.

Mr. Phong also said that as soon as the press reported the incident, "The City Police Department's Board of Directors asked Binh Chanh police to report. We have prepared a preliminary report to submit to the leaders of the General Department of Politics on how to handle related personnel."
