Land acquisition problems for the Friendship General Hospital project need to be resolved soon
(Baonghean) - Mr. Nguyen Duc Chuong sent a petition to Nghe An newspaper reflecting on the inappropriate implementation of compensation and resettlement policies for the Nghe An General Hospital Construction Investment Project Phase 2.
Disadvantaged rights
On February 24, 2017, Nghe An Newspaper received a petition from Mr. Nguyen Duc Chuong, residing in Hamlet 14, Nghi Phu Commune (Vinh City), in which he informed: His family's residential land has an area of 674.2 square meters (plot number 88, map number 25, Hamlet 14, Nghi Phu Commune) located in the planning area of the Nghe An General Hospital, Phase 2, New Construction Project. In June 2014, Vinh City People's Committee carried out site clearance and land acquisition to implement the project.
However, families in the project area did not agree with the compensation and support plan for land clearance and filed a complaint. On May 26, 2015, the Provincial People's Committee issued Decision No. 326 adjusting the compensation price; and then Vinh City issued Decision No. 9767 approving the adjustment and supplement of the detailed plan for compensation, support, and resettlement for project site clearance according to the price adjustment decision of the Provincial People's Committee. Complying with the land clearance decision of the city government, at the end of 2015, he was notified by the City Land Fund Development Center to receive 4 resettlement land lots.

Because he is a 2/4 disabled veteran, Mr. Chuong was instructed by the City Land Fund Development Center to prepare a dossier for exemption from land use fees for a resettlement plot according to the policy for people with revolutionary contributions (in February 2016). However, at that time, the Vinh City People's Committee did not consider and resolve the matter in a timely manner. On December 12, 2016, the Vinh City People's Committee issued Official Dispatch No. 7129 stating that the policy of exemption from land use fees for people with revolutionary contributions had ended, so Mr. Chuong's household was not entitled to the land use fee exemption policy.
Mr. Chuong wrote: “I am a 2/4 disabled veteran, a retired military officer; I participated in Party work for a long time in Nghi Phu commune, so I am aware of the need to strictly follow the policies of the Party and the State. In 2016, although I am not “old enough”, I still built a house so that the project could be implemented. While my wife was building the house, she had an accident and fell from the 2nd floor, suffered multiple traumatic brain and spinal injuries, and had to be continuously treated at Central hospitals; after more than 7 months, she is still paralyzed on one side and is being treated at the Provincial General Hospital of Friendship. Therefore, my situation is extremely difficult.
Regarding the implementation of land use fee exemption for people with meritorious services to the revolution, the city government also informed me about this policy when implementing land recovery. If it is said that up to now the policy is no longer effective, the reason is due to the extension of the time for compensation and site clearance and the settlement of policies by the city government. Therefore, I hope that the authorities at all levels will consider and resolve the land use fee exemption for me, ensuring the rights and policies of the Party and State for people with meritorious services...
"Partly the state's fault"
Regarding the land recovery for the Nghe An General Hospital Friendship Project, there are 3 households that still have problems with the release of assets on the land, so on January 27, 2017, Vinh City established a Board to enforce land recovery in Decision No. 854.
On March 7, 2017, the Enforcement Committee organized a dialogue with the relevant households. Mr. Ha Thanh Tinh - Vice Chairman of Vinh City People's Committee concluded at the dialogue that he requested 3 households to carry out site clearance to avoid the government from carrying out enforcement. Regarding Mr. Nguyen Duc Chuong's household, the City Department of Natural Resources and Environment was assigned to report to the Provincial People's Committee to consider the proposal to allow exemption or reduction of land use fees.
On March 13, 2017, Vinh City issued Official Dispatch No. 1270 regarding the settlement of the petition of Mr. Nguyen Duc Chuong's household and another household. Regarding Mr. Chuong's inability to enjoy the land use fee exemption policy, Vinh City People's Committee found that "it was partly the State's fault". The reason was that the land acquisition for the project started before July 1, 2014 (the effective date of the 2013 Land Law). At this time, according to the provisions of Clause 7, Article 11, Decree No. 120, subjects subject to the policy are entitled to land use exemption and reduction when the State allocates resettlement land. However, "the compensation price is not reasonable, so it must be adjusted, and the time is extended, so it is past the effective date".
Vinh City People's Committee stated: "Based on the guidance of the Ministry of Finance in Section 2 of Official Dispatch No. 144/BTC-QLCS dated October 13, 2016, in order to support people with meritorious services to the revolution who are facing difficulties in the event of land repossession and resettlement, depending on the actual conditions and capabilities of the locality, the Provincial People's Committee shall decide on the maximum forms of support according to the resettlement compensation policy or other forms of support according to the policy for people with meritorious services to the revolution."
Vinh City People's Committee reports and respectfully requests the Provincial People's Committee to consider allowing Vinh City People's Committee to apply other support measures to Mr. Chuong in the direction of reducing the land use fee for 1 plot of land when being compensated by being allocated new residential land.
Need to consider resolution
Since 2004, Mr. Nguyen Duc Chuong had applied to divide his land plot No. 88 into 4 plots for his family members. At that time, Vinh City People's Committee issued a decision, announcing the tax payment, including tax exemption for 1 plot of land because Mr. Chuong was a subject of the policy for people with revolutionary contributions. Mr. Chuong then paid the tax to the City State Treasury.
However, after inspection, Vinh City People's Committee determined that Mr. Chuong's land plot was part of the construction planning of Nghe An General Hospital, phase 2, so they decided to stop carrying out the procedures for dividing the land plot and granting the land use right certificate to Mr. Chuong (up to now, Mr. Chuong has not yet recovered the money he paid to the State Treasury of Vinh City).
Also because of this incident, when reviewing the land use fee exemption policy (at the time of land acquisition and compensation in 2016) for Mr. Chuong, the City Tax Department reported in writing that Mr. Chuong had enjoyed the policy for people with meritorious services to the revolution. However, when Mr. Chuong requested to review this content, after inspection, the Vinh City People's Committee had to correct the City Tax Department's report; leading to delays in resolving policies for people with meritorious services like Mr. Chuong.
As an officer participating in the dialogue to resolve the problems of 3 households of Nghe An General Hospital Friendship Project on March 7, 2017, Mr. Le Quoc Hong - Head of Vinh City Party Committee's Mass Mobilization Committee discussed: At the dialogue, I have the opinion that Vinh City People's Committee should request the Provincial People's Committee to consider and resolve the land use fee exemption and reduction policy according to the policy for meritorious people when recovering residential land for Mr. Nguyen Duc Chuong's household, so that he will not be disadvantaged...
After Vinh City People's Committee submitted Official Letter No. 1270/UBND-TNMT, the Provincial People's Committee assigned relevant departments and branches to advise on a solution. "Currently, the site of Nghe An General Hospital Friendship Project has been completely cleared. Regarding Mr. Nguyen Duc Chuong's proposal, Vinh City People's Committee has issued Official Letter No. 1270 with a detailed report, requesting the Provincial People's Committee to allow the city to apply other support measures for Mr. Chuong in the direction of reducing the land use fee for 1 plot of land. Currently, the city is waiting for the Provincial People's Committee to direct the resolution of this content..." - Mr. Ha Thanh Tinh - Vice Chairman of Vinh City People's Committee said.
