Determine the compensation responsibility of the person directly causing the wrongful conviction

At the same time, it requires that in addition to the State's responsibility for compensation, it must determine the responsibility for compensation of those directly involved in the investigation, prosecution, and trial leading to wrongful convictions.

Regarding this issue (in Official Dispatch No. 460/UBTP14), the National Assembly's Judiciary Committee responded as follows:

In implementing the provisions of the Constitution, the Law on Organization of the National Assembly and the Law on Supervision Activities of the National Assembly, every year the Judicial Committee of the National Assembly has presided over and coordinated with the Council of Nationalities and the Committees of the National Assembly to conduct activities to supervise the law enforcement of judicial agencies (Investigation agencies, Procuracy, Courts, Enforcement agencies at all levels) and supervise the compensation for people wrongly convicted in criminal proceedings according to the provisions of the Law on State Compensation Liability and other relevant legal documents.

Through its monitoring activities, the Judiciary Committee has recommended that relevant judicial agencies take many measures to overcome limitations and shortcomings, improve the quality of investigation, prosecution, trial, and execution of judgments, and limit the occurrence of injustice and mistakes; and strengthen the settlement of complaints. Many wrongful convictions have been clarified, and the wronged have been compensated in accordance with the law.

However, the Judiciary Committee's supervisory activities, despite its efforts, have not yet met all the voters' requirements.

In response to voters' opinions, the Judiciary Committee will strengthen coordination with relevant agencies to more closely monitor the law enforcement of judicial agencies, contributing to ensuring fair and lawful settlement of cases, minimizing wrongful and erroneous investigations, prosecutions, and trials; monitoring the compensation process for wrongly convicted people by the prosecution agency and clearly defining the personal responsibilities of those who directly conducted the proceedings to prevent wrongful convictions in order to protect the legitimate rights and interests of citizens.
