Verify assets and income when there are signs of unusual increases or decreases in assets and income without reasonable explanation.

Continuing the 7th plenary session, on September 6, the National Assembly's Judicial Committee gave its opinion on the draft revised Law on Anti-Corruption (AC). According to the Government Inspectorate, based on the importance of transparency measures and control of assets and income in anti-corruption, the draft has stipulated a separate chapter with many new provisions, essentially aiming to control the assets and income of cadres, civil servants, public employees and some other people with positions and powers.

The Government Inspectorate said that regarding the obligation to declare assets and income, the draft provides clearer regulations when requiring people with the obligation to declare assets and income to declare and additionally declare their own assets and income, those of their spouse and minor children.

Regarding the subjects of declaration, there are major adjustments in the spirit of Resolution 3 of the Central Committee (10th tenure) for all civil servants when appointed to a rank; officials holding leadership and management positions; cadres and civil servants when elected, appointed, reappointed...

This draft has removed the regulation on annual declaration and replaced it with initial declaration and supplementary declaration. Initial declaration is made for all persons who are obliged to declare immediately after the amended Law takes effect. Supplemental declaration is made for persons who have made initial declaration and are expected to be elected, appointed, reappointed, or assigned as representatives of state capital in enterprises; when there is a change in assets or income worth VND50 million or more.

According to the Government Inspectorate, the draft regulation stipulates that the declaration of assets and income of a person with the obligation to declare must be made public at the agency, organization, or unit where that person regularly works.

The declaration of assets and income of a person expected to be appointed to a leadership or management position at an agency, organization or unit must be made public at the meeting to vote on confidence when conducting the appointment process. The draft law adds an option to make it public specifically for each group of subjects.

The draft also expands the basis for verifying assets and income compared to current regulations, including: When there are clear signs of dishonest and non-transparent declarations or when there are signs of unusual increases or decreases in assets, income, and expenditures without reasonable explanation; when there are accusations about asset and income declarations; stipulates mandatory verification for those expected to be elected, appointed, assigned to hold positions and receive responsibility allowances of 0.9 or higher and other positions (as prescribed by the Government) in order to build a team of honest cadres, civil servants, and public employees...
