Negotiating, signing, and implementing collective labor agreements (CLAs) in enterprises is an important and necessary solution that contributes to protecting the legitimate rights and interests of workers and helps enterprises develop sustainably.
Enhancing workers' rights

Mr. Nguyen Dang Manh, Chairman of the Trade Union of Sangwoo Co., Ltd., stated: The company's Collective Labor Agreement (CLA) has been signed with many clauses exceeding the provisions of the Labor Law, bringing practical benefits to employees. For example, the basic salary is 4,950,000 VND (regional regulation is 4,160,000 VND). Allowances and support are also very good, such as an attendance allowance of 300,000 VND/person; a responsibility allowance of 150,000 VND or more; a seniority allowance of 50,000 - 250,000 VND; and a meal allowance of 20,000 VND/person/day.
Furthermore, based on the unique cultural characteristics of the Vietnamese people and legal regulations, the Collective Labor Agreement of Sangwoo Co., Ltd. also stipulates other clauses such as: Tet bonus equivalent to one month's salary subject to social insurance contributions; employees who get married or become ill will receive support of 200,000 VND/person; employees who suffer work-related accidents will receive support ranging from 200,000 to 1,000,000 VND/person depending on the severity...
Similar to the Sangwoo Company Limited Trade Union, the Kyungsing Company Trade Union has also contributed to building and signing collective bargaining agreements that benefit workers, creating stability for the enterprise. Ms. Tran Thi Huong - President of the Kyungsing Company Trade Union - said: The basic salary at the enterprise is 5 million VND (regional regulation is 4,160,000 VND); telephone allowance of 200,000 - 500,000 VND/person; housing support of 500,000 VND/person/month; fuel allowance of 300,000 - 2,000,000 VND/person; birthday gift of 250,000 VND; wedding gift of 500,000 VND; funeral assistance of 2 million VND... In addition, workers with particularly difficult circumstances are considered for support depending on the level and length of service.

Collective bargaining agreements (CBAs) are agreements reached through collective bargaining and signed in writing by the parties. The content of a CBAs must not contradict the provisions of the law; it should ideally be more beneficial to workers than the provisions of the law. The executive committee of the grassroots trade union has the right to represent the workers in signing and monitoring the implementation of CBAs.
On May 10th, the Trade Union of the Southeast Economic Zone awarded commendations to 10 collective bargaining agreements (CBAs) from 10 enterprises within the economic zone. According to the Trade Union of the Southeast Economic Zone, the awarded CBAs have the advantage of offering significantly higher salaries and allowances than the regional minimum wage. Employee benefits are clearly defined, strictly implemented, and guaranteed in accordance with the law. In many units, these benefits even exceed the legal requirements.
Joining forces to create sustainable development
It is known that in recent years, the number of workers, laborers and businesses in these areas has increased.industrial zoneNghe An province is experiencing rapid growth, with over 150 operating businesses and more than 50,000 workers. Of these, 80 businesses have trade union organizations with over 40,000 members. Currently, 58 out of 80 grassroots trade unions have collective bargaining agreements (CBAs); 10 out of 58 CBAs are rated as good; however, many CBAs remain merely 형식적인 (formalistic), superficial, or simply copied from existing laws.
In reality, negotiating and signing a quality collective bargaining agreement is not simple. This stems from the fact that employers always have different perspectives from employees. Employers want to reduce costs and increase profits, while employees desire better working conditions, higher income, and superior benefits.

On the other hand, FDI enterprises also face language barriers, making it difficult to communicate and convey the concerns of workers to employers. Furthermore, there are differences in corporate culture. Employers are often dissatisfied with the work ethic of the majority of their workers. These factors significantly impact the negotiation and signing of collective bargaining agreements.
The quality of collective labor agreements largely depends on the knowledge, courage, and involvement of the trade union and its officials within the enterprise. The chairman of a company's trade union shared: "Once, the company's leadership questioned me, asking why, as the chairman of the trade union and also the head of the human resources department, receiving a salary from the company, I didn't side with the company but only fought for the rights of the workers? - In this 'middle' position, the trade union official must be truly courageous, possess solid knowledge, skills, perseverance, and tact."
The responsibility and involvement of enterprise trade union officials in the development and signing of collective bargaining agreements (CBAs) is demonstrated by their ability to thoroughly understand the thoughts and aspirations of workers; their clear understanding of the enterprise's production and business situation; their ability to analyze information and data about workers; and their firm grasp of laws related to workers' rights... This allows them to then discuss with the employer the practical benefits the enterprise will receive from implementing the contents proposed by the trade union; and to negotiate the terms stipulated in the CBAs.

A high-quality collective bargaining agreement (CBA) will help businesses attract and retain employees, preventing strikes and collective work stoppages in the context of increasingly difficult recruitment and human resource development. Conversely, superior provisions on wages and benefits codified in the collective bargaining agreement help employees trust and remain committed to the company in the long term.
Ensuring workers' rights and improving working conditions will motivate them to work harder, more responsibly, and more efficiently... The signing of collective bargaining agreements has brought double benefits to both workers and employers.
