How much is the fine for an expired car?

The Vietnam Register has just sent a notice to the National Traffic Safety Committee, the Ministry of Public Security, and the Ministry of Transport about a list of vehicles that are about to expire.

To facilitate the search for data on expired vehicles and vehicles about to expire, the Vietnam Register announces the list of expired vehicles via the link "Search for expired XCG vehicles" at www.vr.org.vn and vehicles about to expire via the link "List of motor vehicles expiring from January 1, 2018" at www.vr.org.vn/lib/download.asp. Authorities and relevant parties can download and search for vehicles 24/7.

According to Article 5 of Decree No. 95/2009, the age limit for cargo and passenger cars is as follows: No more than 25 years for cargo cars; No more than 20 years for passenger cars; No more than 17 years for cars converted from other types of vehicles to passenger cars before January 1, 2002.

However, the above regulations do not apply to the following cases: military and police cars serving national defense and security purposes; passenger cars with up to 9 seats (including the driver's seat); specialized cars (cars with structures and equipment to perform a special function or use), trailers and semi-trailers.

The age of a car is calculated from the year of manufacture. In some special cases, when permitted by the Prime Minister, the age of use is calculated from the year of first registration of the car. It is estimated that the total number of cars that will expire from January 1, 2018 is 24,439, including 2,632 passenger cars and 21,807 cargo cars.

According to Article 16 of Decree No. 46/2016, drivers of cars (including trailers or semi-trailers) that are past their expiration date will be fined from 4 to 6 million VND. In addition to the fine, the driver will also have their vehicle confiscated and their driver's license revoked for 1 to 3 months.

According to Article 16 of Decree No. 46/2016, drivers of cars (including trailers or semi-trailers) that are past their expiration date will be fined from 4 to 6 million VND.

Through the work of ensuring traffic safety and order, if the traffic police force detects expired cars, farm vehicles, homemade 3-wheeled and 4-wheeled vehicles participating in traffic in the area, they will make a record, suspend the vehicle's circulation, temporarily hold the vehicle registration certificate and license plate and handle it according to the provisions of law; at the same time, notify in writing the traffic police agency where the vehicle was registered to carry out the procedure to revoke the vehicle registration certificate and license plate.

Within 15 days from the date of notification, if the vehicle owner does not voluntarily come to complete the procedures, the traffic police will coordinate with the commune-level police to revoke the vehicle registration certificate and license plate. The traffic police will notify the list of vehicles that have expired their usage period to the police units and localities tasked with ensuring traffic order and safety for detection and handling in accordance with the provisions of law.
