Appeal trial of Nguyen Nang Tinh's case on charges of anti-state propaganda

Previously, on November 5, 2019, the People's Court of Nghe An province held a first-instance trial of Nguyen Nang Tinh on charges of "Making, storing, disseminating or propagating information, documents and items against the Socialist Republic of Vietnam".

At the first instance trial, documents and evidence investigated and collected by the authorities proved that Nguyen Nang Tinh, through his personal Facebook page, connected with a number of extremist and reactionary elements at home and abroad to write, film, distribute, post, share, and comment on content that distorted the nature of the Socialist Republic of Vietnam, denied the revolutionary achievements of the nation; defamed the people's government, distorted history, violated the people's government and the socialist regime, aimed at opposing the Socialist Republic of Vietnam; defamed the leaders of the Party and State; incited people to protest and oppose the government; posted documents with fabricated content, causing confusion among the people; provided fabricated information to cause conflicts between the people and public authorities...

Nguyen Nang Tinh is a subject with negative and discontented thoughts, a deep sense of opposition, and has activities of connecting, attracting, and being influenced by a number of extremist and reactionary subjects at home and abroad. This is a very dangerous subject, with activities that violate national security with extremely sophisticated and cunning methods and tricks, and has many tricks to deal with law enforcement agencies.

On May 27, 2019, the Investigation Security Agency, Nghe An Provincial Police issued a decision to prosecute the case, prosecute the accused and issue an arrest warrant to detain Nguyen Nang Tinh (born October 4, 1976, hometown Quynh Hung commune, Quynh Luu district, Nghe An province; residing in hamlet 6, Nghi Phu commune, Vinh city; teacher at Nghe An College of Culture and Arts) for the crime of "Making, storing, disseminating or propagating information and documents aimed at opposing the Socialist Republic of Vietnam" as prescribed in Clause 1, Article 117 of the Penal Code.

Based on a full and comprehensive review of documents, evidence, and opinions of the prosecutor and defense attorneys, the Trial Panel of the first instance determined: Considering the behavior and nature of the crime, this is a very serious case, the behavior of the defendant Nguyen Nang Tinh is very dangerous, and occurred over a long period of time.

The defendant took advantage of democratic freedoms in using his personal Facebook, took advantage of domestic political and social issues to distort history, incite the masses, distort, slander, and oppose the people's government...

Defendant Nguyen Nang Tinh committed the crime of: “Making, storing, disseminating or propagating information, documents and items against the Socialist Republic of Vietnam”. Applying Points: a, b, c, Clause 1, Article 117; Article 44, Article 122 of the Penal Code, the first instance court sentenced defendant Nguyen Nang Tinh to 11 years in prison; and placed the defendant on probation for 5 years from the date of completing the prison sentence.

Believing he was wronged, Nguyen Nang Tinh filed an appeal against the first instance verdict.

At today's appeal hearing, the Trial Panel will question the defendant, review and evaluate documents and evidence related to the case to clarify and fully clarify the details of each incident and each crime of the case.
