24 months in prison for those who profited from illegally sending people abroad
(Baonghean.vn) - A criminal case was just brought to trial at the People's Court of Nghe An province on the morning of November 17. However, at this trial, those who suffered losses from illegal acts were not considered victims.
The defendant brought to trial is Hoang Niem (born 1971, residing in Nghi Quang commune, Nghi Loc district), prosecuted for the crime of "organizing others to flee abroad". Although up to 4 families suffered material and spiritual losses due to the defendant's actions, the court determined that they were not victims.
The reason is that they voluntarily and jointly participate in this behavior, although they are aware that such action is not permitted by law. Therefore, they are only people with related rights and obligations.

According to the indictment, in April 2015, seeing Hoang Niem hanging a sign sending people to work in Germany, some people came to his house to inquire, including the parents of four people: Phan Van Bao, Vo Van Trung, Phan Thi Luu (residing in Nghi Thiet commune, Nghi Loc district) and Phung Thi Thao (residing in Nghi Thu ward, Cua Lo town).
Here, Hoang Niem affirmed that he could send people to the Federal Republic of Germany to work under a study VISA for a period of 6 months to 1 year, costing 17,500 USD, deposit 1,500 USD, documents including passport, 4x6 photo, resume, copy of ID card, copy of household registration book and degree.
Trusting Niem and also wanting their children to go to Europe to work, the families of these four people agreed to follow all of Niem's instructions. On May 10-11, 2016, the four families paid Hoang Niem 6,000 USD in deposits and documents. Niem then transferred the money and documents to two other people, Nguyen Hoang Trieu and Tran Dinh Huu.
Afterwards, Huu informed Niem to request the above 4 people to pay an additional 10,500,000 VND each to create a financial proof account and the families paid Niem a total of 42,000,000 VND as requested.
About a month later, Huu informed Niem that he could not get a VISA for these 4 people to go directly to Germany, but had to get a tourist VISA to go to Russia, from there continue the procedures to go to Germany.
In early September 2016, Huu told Niem to take an additional $5,000 from each family to complete exit procedures. On September 12, 2016, Niem received an additional $20,000 from each family, but Niem only transferred half to Huu.
On September 18, 2016, Hoang Niem took 4 people to Noi Bai airport (Hanoi) to go to Russia. However, when the 3-month period in Russia expired, because they could not go to Germany, these 4 people asked Niem to take them back to Vietnam.
After that, these 4 people filed a complaint to the police. On March 27, Hoang Niem was detained by the police, and Tran Dinh Huu fled his residence; as for Nguyen Hoang Trieu, although he received the files of the 4 families, he did not know what Huu and Niem did, so there was not enough basis to handle the case.
At the trial, defendant Hoang Niem confessed to the crime as stated in the indictment. After the incident, Niem voluntarily remedied the consequences and returned the full amount to the families.
After considering the aggravating and mitigating circumstances, the panel of judges decided to sentence Hoang Niem to 24 months in prison, suspended. As for Tran Dinh Huu, the police agency issued a wanted notice and decided to separate the case for separate handling./.
