62 years in prison for group of people who committed murder after birthday party

(Baonghean.vn) - After a week of deliberation, on the afternoon of April 27, Nghe An Provincial People's Court decided to sentence Nguyen Van Duc (born in 1993, residing in Thinh Son commune, Do Luong district) and his accomplices to a total of 62 years and 9 months in prison for the act of "murder".

The case file clearly states that on the birthday of Nguyen Van Dung (born in 1989, residing in Dong Vinh ward, Vinh city, Nghe An), at around 8:00 p.m. on August 28, 2013, Duc, Dung, Le Tien Thanh (born in 1990, residing in Vinh city), Duong Ngoc Quy (born in 1997) and Tran The Ky (born in 1991, all residing in Ha Tinh) went to Family karaoke bar (block 5, Tran Phu ward, Vinh city) to rent room 106 to celebrate the birthday. At the same time, in room 204, Phan Thanh Dat's group (born in 1986, residing in Truong Thi ward, Vinh city) including Dat, Hoang Dang Sang (born in 1984) and Tran Son (born in 1983, all residing in Vinh city) were also drinking beer and singing karaoke.

At 10 p.m. the same day, both groups went down to the reception desk to pay and a conflict broke out. After a few minutes of arguing, Phan Thanh Dat pulled out a pistol with serial number 0267-USA 2010 and pointed it at Dung's stomach, threatening to shoot him. Seeing that, Sang grabbed the gun from Dat's hand and went to the reception desk. Dung and Ky immediately punched and kicked Dat. Nguyen Van Duc, who was standing next to him, pulled out a switchblade he had hidden in his person and stabbed Dat once in the right side of his abdomen. When the victim collapsed, Ky and Quy continued to rush out and hit Dat hard with a glass cup.

After beating Dat, who was lying motionless in a pool of blood, Tran The Ky continued to attack Hoang Dang Sang. Sang immediately took out Dat's gun and pulled the trigger. The gun fired three consecutive shots, hitting Ky in the back. The bloody melee only stopped when the restaurant staff intervened.

Phan Thanh Dat and Tran The Ky were quickly taken to the hospital for emergency treatment, but Dat died due to severe injuries. The results of the examination by the authorities concluded that the cause of Phan Thanh Dat's death was circulatory respiratory failure in a patient who had undergone emergency surgery due to a wound that penetrated the right lung and liver.

After stabbing the victim, Nguyen Van Duc took a taxi to Ben Thuy bridge, threw the knife into Lam river, then took a bus to Hanoi. After 3 days on the run, with the encouragement of his family, on August 31, Duc went to the authorities to confess his actions.

For the above acts, 4 defendants including Nguyen Van Duc, Nguyen Van Dung, Tran The Ky and Duong Ngoc Quy were prosecuted for the crime of “murder”. Le Tien Thanh, Tran Son and Hoang Dang Sang were prosecuted for the crime of “disturbing public order”.

Considering the criminal role of each defendant, the panel decided to sentence Nguyen Van Duc to 20 years in prison, Nguyen Van Dung to 18 years in prison, Tran The Ky to 14 years in prison, and Duong Ngoc Quy to 9 years and 6 months in prison for the act of "murder". At the same time, the 4 defendants were forced to jointly compensate the victim's family a total of 142 million VND (including funeral expenses, mental damage, and raising the victim's young children until adulthood).

The remaining three defendants, including Tran Son, were sentenced to 15 months in prison, Hoang Dang Sang to 12 months in prison (suspended), and Le Tien Thanh to 9 months in prison (suspended) for "disturbing public order."
