(Baonghean) - On August 28, 2018, the Secretariat issued Regulation No. 05-QDi/TW, which clearly stipulates 9 cases of giving birth that are not considered a violation of population policy and family planning.

Article 2, Regulation No. 05-QDi/TW stipulates 9 cases where giving birth is not considered a violation of population policy and family planning, specifically:

1. A couple may have a third child if both or one of them belongs to an ethnic group with a population of less than 10,000 people or belongs to an ethnic group at risk of population decline (a rate less than or equal to the mortality rate) according to the official announcement of the Ministry of Planning and Investment.

2. Couples who have three or more children for the first time.

3. A couple who already have one biological child, have a second birth and have two or more children.

4. A couple giving birth for the third time or more, if at the time of birth there is only one living biological child, including a biological child given up for adoption.

5. A couple may have a third child if they already have two biological children but one or both of them have a disability or a serious non-genetic disease, as confirmed by a provincial or central medical examination board.

6. Couples with children (biological children):

a) Have one or two children, if one of the two people already has a child (biological child).

b) Giving birth to one child or two or more children at the same time, if both people already have children of their own (biological children). This provision does not apply to cases where the two people have had two or more children together and the children are still alive.

7. Unmarried women giving birth to one or more children at the same time.

8. Giving birth to the third child or more before January 19, 1989 (effective date of Decision No. 162-HDBT, dated October 18, 1988 of the Council of Ministers on a number of population and family planning policies).

9. In case of giving birth to a third child due to an unwanted pregnancy, if implementing family planning measures seriously affects the mother's health (with confirmation from a district-level hospital or equivalent or higher).
