Mr. Son: 1 household illegally encroached on land, 30 households have no land for production.
(Baonghean.vn) – The slow resolution of the land encroachment issue of Mr. Nguyen Van Ky (Hamlet 1 – Lang Son – Anh Son) has caused 30 households with fields in the Dong Cay area to be unable to cultivate for nearly a year.
Encroachment on public land, commune slow to resolve
According to Mr. Le Viet Tung (Hamlet 2 - Lang Son Commune), for a long time he filed a complaint about Mr. Nguyen Van Ky (residing in Hamlet 1) illegally encroaching on public land located along the Ho Chi Minh Trail, causing the drainage ditch to become blocked. However, up to now, the authorities have not yet resolved the matter thoroughly, Mr. Ky has built a solid fence to encroach on the land, causing frustration for his family.
Mr. Hoang Van Tam, a cadastral officer of Lang Son commune, acknowledged that the land plot that Mr. Nguyen Van Ky is currently using was transferred from Mr. La Quang Tao, shown in the garden tax department as 438m2.2, and has not been granted a land use right certificate. On August 4, 2015, the People's Committee of Lang Son commune suspended the construction of Mr. Nguyen Van Ky's fence. Through accurate measurement, the area of the fence that Mr. Ky illegally built was 93.3 m2Mr. Ky himself also admitted and signed this violation record.

On March 5, 2016, Mr. Hoang Van Tam, who was then Vice Chairman of the People's Committee of Lang Son Commune, wrote a commitment to Mr. Le Viet Tung to resolve his complaint against Mr. Nguyen Van Ky about this illegal encroachment of the canal. The commitment stated: "To ensure drainage so that the people of Village 1 can plant rice in time according to the crop plan. Now, the People's Committee of the Commune commits to Mr. Le Viet Tung's family to resolve the family's complaint and handle the illegal fence built by Mr. Ky's family in Village 1 no later than May 30, 2016."
The commitment also clearly states that if within the above time, the Commune People's Committee cannot resolve the issue, it will be responsible to Mr. Tung's family and let Mr. Tung's family fill the ditch again. If during that time, Mr. Tung arbitrarily fills the ditch, he will be held responsible before the law.

Up to now, Mr. Ky's family is still illegally encroaching on land that has not been demolished, while Mr. Tung's family has filled in the ditch, causing water in the Don Cay area to stagnate and people cannot produce.
30 households have no land to cultivate
Mr. Le Viet Tung's accusation against Mr. Nguyen Van Ky is true, but the authorities have not yet resolved it. The ditch that Mr. Tung rebuilt has caused water to stagnate, and 1 hectare of rice fields in the Don Cay area have been submerged in water. Since October 2015, 30 households in Hamlet 1 have been unable to cultivate.
On July 12, 2016, 4 households in Hamlet 1, including Mr. Nguyen Dinh Hien, Mr. Nguyen Huu Binh, Mr. Nguyen Huu Thu, and Mr. Chu Van Nam, representing 30 households with fields in the Don Cay area, wrote a petition to the authorities at all levels. The petition clearly stated that since 2014, 30 households with land in Don Cay have grown rice twice a year and paid taxes in full. However, since 2014, the people have sown rice seedlings but have not been able to plow because the water ditches were blocked at the location where Mr. Ky illegally built the fence.

Talking to us, Mr. Nguyen Dinh Hien was upset: “My family has 6 sao of rice fields, 5 of which are concentrated in the Don Cay area. All income depends on that, my children are studying, my wife has passed away. However, since the harvest season last October until now, the fields have been flooded, and the rice that was planted was also flooded when it rained. Since the last Tet, my whole family has had to run around to buy rice to eat. On July 11, 2016, I and other households here still had to go to the commune to pay the agricultural service fund for the above-mentioned rice fields. We have not been able to work for the past 2 seasons, if we don't have rice to eat, how can we pay?”

In the same situation, the households of Mr. Nguyen Huu Binh and Chu Van Nam also depend on farming in the Don Cay area, but the seedlings have grown to 60 cm high but cannot be planted. Most of the households are upset and say that if the government does not solve the problem in a short time, many households will face hunger.
From a case of land encroachment by Mr. Ky and a complaint and denunciation by Mr. Tung that has been prolonged but still not resolved, affecting the lives of many households in the area of village 1. I think that the authorities at all levels need to quickly resolve it to avoid causing prolonged resentment in public opinion.
Mr. Dang Ngoc Thien - Chairman of Lang Son Commune People's Committee, Anh Son District said: "When Mr. Ky violated, the commune drew up a record of administrative violation and requested Mr. Ky to immediately stop the illegal construction. However, taking advantage of the Saturday and Sunday holidays, Mr. Ky's family continued to build, leaving the commune committee unaware. On March 5, 2016, Mr. Tam committed to Mr. Tung's household that he was hasty and made mistakes because the enforcement of property worth over 5 million VND like Mr. Ky's family's was not under the authority of the commune but had to be submitted to the district for resolution. Currently, we have submitted it to the district People's Committee so that the district can issue a decision to enforce Mr. Ky's illegal construction." |
