Three Ministries agree to amend regulations on tuition exemption and reduction records

Decree No. 116/2016/ND-CP stipulates that the components of the application for student support policies can be copies with the original for comparison or certified copies of the original. However, Joint Circular No. 09/2016/TTLT-BGDĐT-BTC-BLĐTBXH stipulates that the application components must have certified copies of related documents.

According to the people's opinion, this regulation creates many costs for people to carry out administrative procedures, especially those with low incomes from poor and near-poor households. The requirement for the documents to be certified copies goes against the spirit of administrative reform of the Government, increases the abuse of certified copies, and creates costs for carrying out administrative procedures...

Through the System for receiving and responding to feedback and recommendations, many people requested the Ministry of Education and Training, the Ministry of Finance and the Ministry of Labor, War Invalids and Social Affairs to reconsider the regulation that the dossier components are certified copies as in the above Joint Circular.

Regarding this issue, the Ministry of Education and Training responded as follows:

Regarding the people's petition, the Ministry of Finance and the Ministry of Labor, War Invalids and Social Affairs agreed in Official Dispatch No. 13190/BTC-HCSN dated October 3, 2017 and Official Dispatch No. 4271/LĐTBXH-TCGDNN dated October 10, 2017.

According to the opinion of the Ministry of Finance, on June 20, 2014, the Prime Minister issued Directive No. 17/CT-TTg on a number of measures to rectify the abuse of the requirement to submit certified copies of documents and papers when carrying out administrative procedures.

In Clause 1 of Directive No. 17/CT-TTg, Ministers and Heads of ministerial-level agencies are assigned the responsibility to:

“c) Directing the review of legal documents regulating administrative procedures under the management of the Ministry and ministerial-level agencies to propose amendments, supplements or amendments, supplements in the direction: Individuals and organizations directly performing administrative procedures at agencies and organizations have the right to choose to submit copies from the original book, certified copies or submit copies presented with the original for comparison;

d) Directing competent affiliated agencies and organizations to handle administrative procedures to review administrative documents issued by agencies and organizations in the form of decisions, notices, official dispatches and other forms of documents, detecting regulations on administrative procedures that are contrary to the provisions in Article 6 of Decree No. 79/2007/ND-CP; amending, supplementing or issuing new documents to replace them according to their authority as appropriate.”

On February 16, 2015, the Government issued Decree No. 23/2015/ND-CP on issuing copies from original books, certifying copies from originals, certifying signatures and certifying contracts and transactions.

Article 6 of Decree No. 23/2015/ND-CP stipulates:

“1. In cases where the law requires submission of copies, the agency or organization responsible for receiving the copies shall not require certified copies but shall have the right to request presentation of the original for comparison. The person who compares is responsible for confirming the accuracy of the copy compared to the original.

2. Agencies and organizations receiving copies issued from the original book or certified copies shall not be required to present the original, except in cases where there is evidence that the copy is forged or illegal, in which case they shall be required to present the original for comparison or verification, if deemed necessary.

Accordingly, to ensure proper implementation of the spirit of Directive No. 17/CT-TTg dated June 20, 2014 of the Prime Minister on a number of measures to rectify the abuse of the requirement to submit certified copies of documents and papers when carrying out administrative procedures and Article 6 of Decree No. 23/2015/ND-CP dated February 16, 2015 on issuing copies from original books, certifying copies from originals, certifying signatures, contracts, and transactions, the Ministry of Finance requests the Ministry of Education and Training to study and report to the Government on the amendment of Decree No. 86/2015/ND-CP dated October 2, 2015 regulating the mechanism for collecting and managing tuition fees for educational institutions in the national education system and the policy of exempting and reducing tuition fees, and supporting learning costs from the 2015-2016 school year to the 2016-2017 school year. 2020-2021, which stipulates the components of the application documents to be submitted in the following direction: Applicants for tuition exemption and reduction and support for study costs can choose to submit a copy with the original for comparison; submit a certified copy; a copy from the original book or the original.

On the side of the Ministry of Labor, War Invalids and Social Affairs, the Ministry believes that Mr. Nguyen Van Tuan's proposal on the composition of the application for tuition exemption and reduction and support for learning costs is reasonable. Therefore, the Ministry of Labor, War Invalids and Social Affairs requests the Ministry of Education and Training to preside over reviewing and amending the regulations on the composition of the application for tuition exemption and reduction and support for learning costs in accordance with management requirements and to create convenience for the people.

With the consensus of the Ministry of Finance, the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Education and Training will receive and preside over, coordinate with the Ministry of Finance, the Ministry of Labor, War Invalids and Social Affairs to consider amending Circular 09/2016/TTLT-BGDĐT-BTC-BLDTBXH in the coming time.
