Abolish a series of procedures related to businesses and investments

Simplification related to administrative procedures in 5 areas under the state management functions of the Ministry of Planning and Investment.

The Government has just issued Resolution 136/NQ-CP approving a plan to simplify administrative procedures and citizen papers related to population management within the state management scope of the Ministry of Planning and Investment.

Accordingly, the simplification content relates to administrative procedures in 5 areas, including: Establishment and operation of enterprises; Establishment and operation of cooperatives; Investment from Vietnam to foreign countries; Investment in Vietnam and bidding.

In particular, in the field of business establishment and operation, simplify the group of 5 procedures: Registering to establish a private enterprise; registering to establish a single-member limited liability company; registering to establish a limited liability company with two or more members; registering to establish a joint-stock company; registering to establish a partnership company; group of 3 procedures: Registering to establish a single-member limited liability company from separating an enterprise; registering to establish a limited liability company with two or more members from separating an enterprise; registering to establish a joint-stock company from separating an enterprise;...

Simplify procedures in five areas, including: Establishment and operation of enterprises; Establishment and operation of cooperatives; Investment from Vietnam to foreign countries; Investment in Vietnam and bidding.

In addition, simplify administrative procedures for registering business households; registering changes to business household registration contents. In particular, for procedures for registering changes to business household registration contents, regarding the composition of the dossier, abolish the regulation on submitting "valid copies of citizen identification cards or valid identity cards or passports of individuals participating in the business household or household representatives".

Regarding application forms and declaration forms, replace the provisions of "residence address, number and date of issue of valid citizen identification card or identity card or passport" with "personal identification number" at Point d, Clause 1, Article 71 of Decree 78/2015/ND-CP; replace the information about citizens stated in Clause 1, Article 9 of the Law on Citizen Identification 59/2014/QH13, information on "Citizen identification card" and other personal identification documents" in the request forms, application forms, declarations,... issued with Circular No. 20/2015/TT-BKHĐT dated December 1, 2015 guiding on business registration with the information: "surname, middle name and given name; personal identification number".

In the bidding field, simplify the registration procedure to participate in the national bidding network system. Specifically, regarding the dossier components, abolish the requirement on the dossier components being "A copy of the identity card or passport of the legal representative of the registered bidding party" at Point b, Clause 1 and Point b, Clause 2, Article 6 of Joint Circular No. 07/2015/TTLT-BKHĐT-BTC dated September 8, 2015 detailing the provision and posting of information on bidding and contractor selection online.

The Government assigns the Ministry of Planning and Investment, based on the content of the Administrative Procedure Simplification Plan approved by the Government, within the scope of its authority, to preside over and coordinate with relevant ministries, branches and agencies responsible for amending, supplementing, replacing or canceling, abolishing administrative procedures and citizen papers prescribed in legal documents to promulgate according to its authority or submit to competent authorities for promulgation in accordance with the time of completion and operation of the National Population Database.

The Government Office monitors, inspects the implementation and synthesizes difficulties of the Ministry of Planning and Investment and relevant ministries and branches to promptly report to the Prime Minister for resolution in the process of implementing the administrative procedure simplification plan approved by the Government in this resolution.
