Severe sentence for those who disregard the law

Arrogant attitude
On the morning of September 18, the People's Court of Hoang Mai Town conducted a first-instance trial of the criminal case against defendant Nguyen Van Oai (born in 1981, residing in Hamlet 4, Quynh Vinh, Hoang Mai Town) for the crimes of resisting people on official duty as prescribed in Article 257; the crime of failing to comply with judgments as prescribed in Article 304 of the 1999 Penal Code.
At the trial, although Nguyen Van Oai did not confess honestly, the documents and evidence collected by the investigation agency and reviewed and evaluated by the Trial Panel at the trial showed that these documents and evidence were collected objectively, comprehensively, and in accordance with the procedures prescribed by the Criminal Procedure Code.
The statements of the defendant, persons with related rights and obligations, and witnesses in the case are consistent with the time, space, location, and circumstances of the case and are consistent with other documents and evidence, and are consistent with the appraisal results of the professional agency.

The documents and evidence presented at the trial are all valuable in proving Nguyen Van Oai's criminal behavior. Accordingly, after Nguyen Van Oai completed his prison sentence at Nam Ha Prison, he was transferred to his residence in Quynh Vinh Commune, Hoang Mai Town to continue serving an additional year of probation, prohibited from leaving his place of residence according to the first instance judgment No. 01/2013/HSST dated March 9, 2013 of the People's Court of Nghe An Province, Nguyen Van Oai intentionally did not comply with the regulations on probation, did not accept the management and education of the local authorities, and frequently violated his probation obligations right from the first week of his return to his place of residence.
During the period from August 3, 2015 to January 19, 2017, Nguyen Van Oai did not fulfill his obligation to appear once a month in the first week of the month and report to the People's Committee of Quynh Vinh Commune according to the provisions of the Law on Enforcement of Criminal Judgments without any reason. The authorities have repeatedly reminded him and issued decisions to impose administrative penalties, but Nguyen Van Oai still deliberately did not comply with a defiant and fiercely opposing attitude.
Typically, at around 4:00 p.m. on September 1, 2016, implementing Plan No. 829/KH-CATX dated August 23, 2016 of Hoang Mai Town Police on inspecting and controlling the execution of probation sentences in Quynh Vinh Commune. The working group went directly to Nguyen Van Oai's residence in Hamlet 4, Quynh Vinh Commune to inspect and send a notice requesting the execution of the probation sentence in accordance with the order and procedures prescribed by law.
Although he knew that they were people performing official duties, Nguyen Van Oai cursed, used force, used a stick to beat members of the working group, tore up the notice from the local government, shouted to mobilize people around to put pressure, making the working group unable to carry out the assigned tasks...
A word of warning
Based on the evidence and documents examined at the trial and the results of the debate at the trial, on the basis of a full and comprehensive review of the evidence documents, opinions of the prosecutor, defendant, and defense attorney, the Trial Panel determined: The acts of defendant Nguyen Van Oai constituted the crimes of "Failure to comply with judgment" and "Resisting a person on official duty", as prescribed in Article 304 and Clause 1, Article 257 of the Penal Code.
After deliberating and synthesizing the penalties, the Trial Council sentenced Nguyen Van Oai to 5 years in prison, the prison term calculated from the date of detention (January 19, 2017) and a probation sentence, prohibited from leaving the place of residence within 4 years from the date of completion of the prison sentence of this sentence.

When the verdict was announced, many people attending the trial agreed with the harsh verdict, punishing the right person for the right crime.
Defendant Nguyen Van Oai was born and raised when the country was peaceful and independent. To have a peaceful and independent environment for the defendant to grow up, many generations of Vietnamese people had to sacrifice blood, sweat and tears to gain independence and build the country.
The defendant should have trained and strived to become a useful person for society, "living a good life, following good religion", worthy of family tradition, but the defendant listened to reactionary elements, participated in activities aimed at overthrowing the people's government, opposing the State, and going against the interests of the entire nation.
Having been brought to trial and sentenced to 4 years in prison, Nguyen Van Oai had to take this as a lesson, to improve himself to become a filial son, a good husband, a useful citizen for society, but the defendant still deliberately did not comply with an attitude of defiance, resistance, and more determination, committing many acts of law violation, showing recklessness, disregard for the discipline of the law, causing danger to society.
Then, when he was given the last word at the trial this morning (September 18, 2017), defendant Nguyen Van Oai was afraid: "Please consider letting me return to my family soon."
This will also be a lesson and a warning for those who still intend to disregard the law, go against the interests of the people, and sabotage the Party and the State.

Previously, on January 8 and 9, 2013, the People's Court of Nghe An province held a public first-instance trial of the criminal case against 14 defendants, including Nguyen Van Oai, for the crime of "Activities aimed at overthrowing the people's government" as prescribed in Article 79 of the Penal Code. The defendants prosecuted in this case have traveled abroad many times to attend training courses directly introduced by the leaders of Viet Tan - a reactionary organization in exile abroad. Viet Tan also provided money and equipment such as computers, cameras, cameras, phones, etc. and directed the defendants to give them aliases so that they could return to the country to carry out activities against the State and destroy the peaceful lives of the people. At this trial, defendant Nguyen Van Oai confessed: “I am a member of the Viet Tan Party, admitted on November 26, 2010 at Hai Au Hotel, Cua Lo Town”. At the end of the trial, the Trial Council sentenced 14 defendants for the crime of “Activities aimed at overthrowing the people’s government” to a total of 82 years in prison, of which defendant Nguyen Van Oai was sentenced to 4 years in prison and placed on probation for 4 years from the date of completing the main sentence. |
