The Provincial People's Council's Legal Committee supervises at the Provincial Civil Judgment Enforcement Department

(Baonghean.vn) -Continuing the preparation for the 10th session of the 11th Provincial People's Council, on the afternoon of November 6, the Legal Committee of the Nghe An Provincial People's Council had a working session with the leaders of the Provincial Civil Judgment Enforcement Department (CJEA) to monitor the Law on Civil Judgment Enforcement, the results of 2013, the direction and tasks of the JEA in 2014 and the results of the implementation of the Legal Committee's recommendations on the field of JEA in the locality. Comrade Tran Van Mao, Standing Member of the Provincial People's Council chaired the meeting.

In 2013, in addition to advising People's Committees at all levels to perform the state management function of civil judgment enforcement, the Civil Judgment Enforcement sector directly managed and directed the implementation of judgment enforcement tasks such as organizing the dissemination of Resolution 37 of the National Assembly on assigning enforcement targets to the Ministry of Justice and the General Department of Civil Judgment Enforcement, providing guidance on judgment enforcement procedures to ensure timeliness and compliance with the law, establishing specialized inspection teams to issue judgment enforcement decisions and classify judgments at 14 units, reaching 93%.

Of the total 14,324 cases in 2013, the number of newly accepted cases was 10,112, in 2012, 4,212 cases were transferred; after classification, there were 11,286 cases with conditions for execution, 10,708 cases were completed, reaching 95%; the number of cases transferred to 2014 was 3,616, down from 596 cases transferred in 2012; the total amount of money accepted was nearly 272 billion VND, an increase of 33 billion compared to 2012; 137 billion/the amount of money with conditions for execution was 166.8 billion VND. Compared to the targets assigned by the National Assembly, the Ministry of Justice, and the General Department of Civil Judgment Enforcement, the Department of Civil Judgment Enforcement exceeded the number of cases by 7%, the number of money by 5%, and decreased by 7% in the number of cases transferred to the following year.

In addition, in 2013, the THADS Agency proposed to consider exemptions and reductions of 324 cases, equivalent to VND 1,743 billion, of which 312 cases were exempted and reduced with VND 1,463 billion; decided to apply enforcement measures in 51 cases, of which 9 cases were voluntarily enforced and 42 cases were enforced; handled and resolved 41/46 complaints and denunciations about THADS, a decrease of 10 cases compared to 2012.

At the meeting, the representative of the provincial THADS Department pointed out some limitations and shortcomings when the number of cases transferred to the next period, although reduced compared to 2012, was still high, especially in terms of money (134 billion VND with 3,600 cases); the results of handling complaints and denunciations were low (89%); the verification of conditions for execution of judgments in some cases was slow, and the information was not really complete. On the side of the Legal Department, along with acknowledging the changes in THADS in recent times, the representative of the Legal Department answered a number of recommendations and proposals of the Department under its authority; at the same time, raised a number of questions about cases of slow execution, the rate of cases transferred to the next period, the rate of difficult and prolonged enforcement cases, criteria for determining cases eligible for enforcement or consideration of exemption or reduction of enforcement.
