Mr. Kien is in jail and suing: Opportunity to pocket 190 billion VND

Because he is serving a prison sentence, Mr. Nguyen Duc Kien cannot continue to execute the two contracts signed with the defendant. Therefore, he and his sister filed a lawsuit to reclaim more than 190 billion VND. The Procuracy proposed that “boss” Kien win the lawsuit.

On September 28, the Economic Court (HCMC People's Court) opened a trial for a dispute between the companies of "boss" Kien related to the amount of 190 billion VND.

According to the case, on September 5, 2016, Ms. Huong (sister of Mr. Nguyen Duc Kien, also known as “boss” Kien) represented B&B to sue ACI for more than 190 billion VND. On October 11, 2016, “boss” Kien (currently serving a criminal sentence) filed a lawsuit against ACI with the same request as his sister.

According to B&B's lawsuit, the company requested the court to annul the two share transfer contracts between B&B and ACI and requested the court to force ACI to jointly with ACB Bank to return more than VND190 billion to B&B. According to the lawsuit, B&B paid ACI more than VND190 billion under the two contracts.

However, according to the defendant, ACI actually only received 101 billion VND, and the remaining 89 billion VND was used by "boss" Kien and his sister, Ms. Huong, to withdraw money from ACI and transfer it to B&B.

Because in 2009 - 2010, Mr. Kien was Chairman of the Board of Directors of ACI Company, Chairman of the Board of Directors of B&B Company, Chairman of the Board of Directors and General Director of AFG Company... With that leadership position, Kien conjured up, bought and sold shares of companies to each other to withdraw money.

At the previous trial, both the plaintiff and the defendant requested to summon “boss” Kien to court to clarify a number of issues. However, after reviewing the case file, the Trial Panel decided not to summon defendant Nguyen Duc Kien.

The representative of the People's Procuracy said that before Mr. Kien was involved in the case of illegal business and intentional violation, the court determined that Mr. Kien's roundabout share trading was an illegal business act and Mr. Nguyen Duc Kien - the person who directly signed and executed the above contract, was criminally prosecuted for this crime.

From there, the representative of the People's Procuracy proposed to declare the two above-mentioned share transfer contracts null and void and requested the court to force ACI to jointly cooperate with ACB Bank to return more than 190 billion VND to B&B.

Due to the complexity of the case, the panel of judges decided to extend the deliberation.
