Social Insurance is assigned the function of specialized inspection of social insurance and health insurance.
(Baonghean)- On March 31, 2016, the Prime Minister signed and issued Decree 21/2016/ND-CP regulating the implementation of specialized inspection functions on social insurance, unemployment insurance, and health insurance payments by social insurance agencies.
This Decree stipulates the duties and powers of agencies and heads of social insurance agencies in performing specialized inspection functions on social insurance, unemployment insurance and health insurance contributions; standards and regimes of persons assigned to perform specialized inspection tasks on social insurance, unemployment insurance and health insurance contributions; specialized inspection activities on social insurance, unemployment insurance and health insurance contributions.

Agencies performing specialized inspection functions on social insurance, unemployment insurance, and health insurance payments include: Vietnam Social Security; Provincial Social Security.
Regarding the duties and powers of specialized inspection of social insurance payments:
Annually, based on the inspection program orientation of the Government Inspectorate and state management agencies on social insurance, unemployment insurance, and health insurance, Vietnam Social Security develops, approves, and organizes the implementation of a specialized inspection plan on social insurance, unemployment insurance, and health insurance contributions; sends the inspection plan to report to the Government Inspectorate and state management agencies on social insurance, unemployment insurance, and health insurance.
Vietnam Social Security will inspect cases when it detects signs of violations of the law on social insurance, unemployment insurance, and health insurance contributions or when assigned by the head of the state management agency on social insurance, unemployment insurance, and health insurance.
Monitor, urge and inspect the implementation of conclusions, recommendations and post-inspection handling decisions of Vietnam Social Security and provincial Social Security. At the same time, summarize and report the results of specialized inspection work on social insurance, unemployment insurance and health insurance contributions according to the provisions of inspection law to state management agencies on social insurance, health insurance and unemployment insurance.
Annually, based on the inspection program orientation of Vietnam Social Security, the provincial Inspectorate, the state management agency of social insurance, unemployment insurance, and health insurance at the local level, the provincial Social Security shall develop, approve and organize the implementation of a specialized inspection plan on social insurance, unemployment insurance, and health insurance contributions in the province; send the inspection plan to report to Vietnam Social Security, the provincial Inspectorate and the state management agency of social insurance, unemployment insurance, and health insurance in the province.
Provincial Social Insurance will inspect cases when detecting signs of violations of the law on social insurance, unemployment insurance, and health insurance contributions or when assigned by the head of Vietnam Social Insurance, provincial Inspectorate, and state management agencies on social insurance, unemployment insurance, and health insurance in the province.
Regarding the duties and powers of the General Director of Vietnam Social Security:Decree 21/2016/ND-CP clearly stipulates the duties and powers of the General Director of Vietnam Social Security in specialized inspection of social insurance, health insurance and unemployment insurance payments.
Specifically: The General Director of Vietnam Social Security leads, directs, inspects and is responsible to the Government and State management agencies on social insurance, health insurance, and unemployment insurance for specialized inspection activities on social insurance, health insurance, and unemployment insurance payments; Decides on planned inspections or inspections when there are signs of law violations and establishes specialized inspection teams on social insurance, health insurance, and unemployment insurance payments; Proposes handling of overlapping subjects, contents, and inspection time of social insurance, health insurance, and unemployment insurance payments.
The General Director of Vietnam Social Security also has the function of recommending to competent authorities to amend, supplement and promulgate legal regulations in accordance with management requirements on social insurance, health insurance and unemployment insurance.
The General Director of Vietnam Social Security decides to sanction administrative violations according to the provisions of law.
Regarding the content and principles of inspection activities, specifically:The contents of specialized inspection on social insurance, health insurance and unemployment insurance payment include: Contribution subjects; Contribution level; Contribution method.
The principles of inspection activities are to comply with the law; ensure accuracy, objectivity, honesty, publicity, democracy, and timeliness; no overlap in scope, subjects, content, and time of inspection among agencies performing inspection functions; no obstruction to the normal operations of agencies, organizations, and individuals subject to inspection; conduct regularly, closely linked to the performance of tasks of social insurance agencies; promptly detect, prevent, and handle violations of the law on social insurance, unemployment insurance, and health insurance contributions; contribute to strengthening the effectiveness of state management in the fields of social insurance, unemployment insurance, and health insurance.
The person assigned to perform the task of specialized inspection of social insurance, health insurance, and unemployment insurance must have a university degree or higher, in a major appropriate to the assigned specialized inspection task. Understand the Party's guidelines and policies, the State's policies and laws. Master the professional regulations and management rules related to the functions and tasks of the agency where he/she works. Have a certificate of professional training in inspection issued by a competent state agency. Have at least 1 year of professional work related to social insurance, health insurance, and unemployment insurance payment activities (excluding internship period).
Persons assigned to perform specialized inspection tasks on social insurance, health insurance, and unemployment insurance payments are provided with uniforms and specialized inspection cards according to regulations of the General Director of Vietnam Social Security; are entitled to allowances when performing inspection tasks according to regulations of law; are trained and fostered in specialized inspection skills...
This Decree takes effect from June 1, 2016.
