Having the last word, the former director of Agribank Ben Thanh earnestly asked the jury to help him donate his body to science after serving his sentence.

On December 13, the trial of Nguyen Thi Hoang Oanh (former director of Agribank Ben Thanh Branch, Ho Chi Minh City) ended the debate and moved to the deliberation.

Faced with the death sentence proposed by the representative of the People's Procuracy, having the last word, defendant Oanh earnestly asked the panel of judges to help her donate her body to science after the execution and asked the panel of judges to consider reducing the sentence for her subordinates.

"The defendant has been a Party member and has made contributions for more than 30 years. Now that the defendant is old, I hope the jury will help me donate my body to medical science after serving my sentence. I hope my family will accept and understand this decision," said defendant Oanh.

Defendants in court

The defendants, who were former subordinates of Oanh, admitted to professional misconduct due to pressure from superiors and requested the court to consider charges of being an accomplice with Oanh in the crime of "embezzlement of property".

Defendant Le Van Tinh, who swindled more than 100 billion VND from Agribank Ben Thanh, insisted that he was innocent of the crime of "giving bribes" and did not admit to the accusation that he had agreed to pay the difference to Oanh to sign a gold loan contract.

Also appearing in court with Tinh were the defendant's wife and children, who were accomplices in the fraud case. Given the last word, the defendant Tinh's wife and children stated that the reason they agreed to let Tinh use their name to establish a company was to help with business, not for the purpose of fraud.

According to the investigation, in 2008, Oanh colluded with her brother-in-law Truong The Thanh (former head of the Planning and Business Department of Agribank Ben Thanh) to commit a series of violations to appropriate state assets.

Accordingly, Oanh directed her subordinates to create fake bank loan and gold documents to appropriate 26,600 taels of gold (equivalent to 47 billion VND) from Agribank Ben Thanh and used this money to buy a house and then lease it back to Agribank Ben Thanh.

Oanh also signed to approve a loan of 13 billion VND for her brother-in-law without requiring any collateral. When the debt was due, Oanh signed more documents in which Thanh used other people's names to borrow money from the bank with the purpose of paying off the debt.

In addition, Oanh also helped Le Van Tinh (Director of Kim Gia Thuan and Kim Gia Thao companies) borrow more than 300 billion VND, but on the condition that Tinh would borrow gold, but Oanh would take the gold and give the money back to Tinh. Each tael of gold was worth 21 million VND, but Oanh only gave Tinh 19 million VND. Oanh would receive the difference.

At the time of the prosecution, the total amount of money and gold that Le Van Tinh owed to Agribank Ben Thanh was more than 300 billion VND.

Previously, defending his client, defendant Oanh's lawyer argued that the defendant did not commit the crimes of "Embezzlement of property" and "Receiving bribes".

Regarding the crime of violating 'regulations on lending in the operations of credit institutions', the lawyer analyzed that the defendant was negligent leading to violations but hoped the panel of judges would consider it because there was no intentional violation.

The lawyer defending Agribank requested the panel of judges to hold Oanh and Tinh responsible for compensating the bank for a total of more than 350 billion VND in damages.

In response to the lawyer's opinion, the representative of the People's Procuracy still maintained the view that Ms. Oanh had taken advantage of her position and responsibility to appropriate Agribank's assets for personal gain.

The judge announced that the panel of judges will announce the verdict at 8:00 a.m. on December 15.
