Fines up to 150 million VND for administrative violations in the field of vocational training
Decree No.79/2015/ND-CPThe Government has just issued regulations stipulating the maximum fine in the field of vocational education for individuals is 75 million VND, for organizations is 150 million VND.
The above Decree stipulates specific penalties for each act. Accordingly, a fine of 5 - 10 million VND shall be imposed for one of the following violations: erasing, deleting, correcting, or changing the content of the decision to establish or permit the establishment; cheating or forging papers and documents to establish or permit the establishment of a vocational education institution or vocational education quality assessment organization.
The act of falsifying papers and documents in the registration dossier for vocational education activities is subject to the following fines: from 5 to 10 million VND for vocational education centers; from 10 to 20 million VND for secondary schools; from 20 to 30 million VND for colleges.
The act of recruiting and organizing training without being granted a certificate of registration for vocational education activities by a competent state agency shall be fined at the following levels: from 40 to 60 million VND for vocational education centers; from 60 to 80 million VND for intermediate schools; from 80 to 100 million VND for colleges.
Failure to teach the required number of hours of study as prescribed in the training program of a subject or module shall be subject to a fine of between VND 300,000 and VND 10 million depending on the severity of the violation.
In addition, organizations that do not develop training schedules, training plans, teacher and lecturer plans according to regulations; do not use or incorrectly use forms and books for teaching and learning management according to regulations will be fined from 3 million to 5 million VND. If they do not comply with regulations on the process of organizing, developing, appraising and issuing training programs, they will be fined from 10 to 15 million VND.
The Decree stipulates a fine of 10 - 20 million VND or suspension of training activities for 6 - 12 months for the act of organizing vocational education activities not in accordance with the training time or training form for vocational education programs with foreign countries.
Penalties for violations of vocational education and training linkage and association
In addition, the Decree also stipulates penalties for violations of regulations on inter-level and joint training in vocational education. Specifically, fines for violations of regulations on inter-level training in vocational education are as follows: From 10 to 20 million VND for organizing inter-level training that does not meet the prescribed conditions; from 30 to 40 million VND for organizing inter-level training in occupations or training levels without the consent of competent authorities.
In addition, the act of using foreign training programs whose quality has not been recognized by competent authorities; not providing information or providing incomplete information on the website of the joint training facility about the joint training program, joint partners, training location, training form, training time, tuition fees, training costs and responsibilities of the parties participating in the joint training will be subject to a fine of 5 - 10 million VND.
The Decree also stipulates a fine of 20-30 million VND for one of the following violations: training cooperation with foreign educational institutions that have not been recognized by a quality assessment agency or organization or a competent authority for quality; training cooperation with foreign educational institutions to train in fields and occupations that are not on the list of fields and occupations permitted for investment cooperation in the field of vocational education in Vietnam; training cooperation without permission from a competent state agency; training cooperation without ensuring conditions for classrooms, facilities, training equipment and teaching staff as prescribed; training cooperation without signing a training cooperation contract or signing a training cooperation contract after organizing training; training cooperation with organizations and individuals that do not have the legal capacity to organize vocational education activities.
