At the citizen reception session, Mr. Pham Xuan Bay, Hamlet 11, Dien Yen Commune, reported that the People's Committee of Dien Chau District was slow to issue the Land Use Right Certificate to his family according to the Appeal Administrative Judgment No. 177/2019/HC-PT, dated July 30, 2019 of the High People's Court in Hanoi and the Decision to enforce the administrative judgment.
According to the authorities, Mr. Pham Xuan Bay's family agreed with the measurement results of the Branch of the Land Registration Office on the shape and area of the land plot, but did not agree with the boundary of the adjacent part with Mr. Vu Van Hoa's family and did not sign the confirmation on the boundary of the adjacent land plot.

Mr. Bay's family requested that the eastern boundary - that is, the border between his family's land and Mr. Vu Van Hoa's family's land - must show a rural road. However, Mr. Vu Van Hoa's family is currently using land adjacent to Mr. Bay's family's land, which does not show a road.
Therefore, up to now, the measurement and correction of cadastral maps to serve the preparation of registration dossiers for granting Certificates of land use rights, house ownership rights and other assets attached to Mr. Bay's family's land at the above land plot has not been carried out.

After listening to the opinions of citizens and the People's Committee of Dien Chau district, the People's Committee of Dien Yen commune... Concluding this content, Provincial Party Secretary Thai Thanh Quy emphasized that the key to resolving the case is to determine whether or not there is a road located on the eastern boundary between the land plot of Mr. Pham Xuan Bay's family and the land plot of Mr. Vu Van Hoa's family.
On that basis, the Provincial Party Secretary assigned the Provincial People's Committee to direct the Department of Natural Resources and Environment to establish an independent working group, requesting Dien Chau district to provide complete documents and procedures to determine whether this road exists or not. The time to complete is 1 month, thereby reporting to the Citizen Reception Council of the Provincial Party Secretary to direct the final settlement of the matter.
The head of the Provincial Party Committee also noted that the implementation process also determined the responsibilities of the relevant parties, and that any shortcomings of the commune government (if any) must also be handled. At the same time, through this incident, it is requested that the district's viewpoint in resolving the cases must be clear.

Next, the Provincial Party Secretary received citizen Pham Binh, Tan Phuong block, Vinh Tan ward, Vinh city. Mr. Binh requested the Vinh City People's Committee to issue a Land Use Rights Certificate for an area of 400m2which his family uses as a house in Tan Phuong block, Vinh Tan ward.
Regarding this issue, the citizen's petition has been considered and resolved by the competent authorities according to regulations. Specifically, regarding the origin of the above land area, in 1989, Mr. Binh took over the pumping station of Vinh Urban Infrastructure Management and Development Company and built a house on an area of 126.5m2.2andagricultural production around it.
When the Provincial People's Committee decided to reclaim the above land area to hand over to the investor to implement the urban project, Mr. Binh was not compensated for the land. The reason is that on the cadastral maps, this is shown as specialized land according to the provisions of the Land Law and only about 80% of the assets on the land are supported.

At that time, Vinh City supported Mr. Binh with 44.8 million VND, he received the support money and signed a commitment to hand over the land. In 2011, Mr. Binh complained about the decisions of Vinh City People's Committee on the issue of not compensating for the land. After that, during the settlement process, Vinh City People's Committee still decided to compensate Mr. Binh with 126.5m2. The difference in land area when being arranged for resettlement had to be paid, he was also supported by the project investor.
Disagreeing with the settlement decisions, Mr. Pham Binh filed a lawsuit at the Vinh City People's Court, Nghe An Province People's Court, and the Supreme People's Court. The court agencies all affirmed that the Vinh City People's Committee had resolved the case reasonably, even though Mr. Binh did not meet the conditions for resettlement land. The Provincial People's Committee also directed the relevant agencies to review and affirmed that the Vinh City People's Committee's settlement was completely correct and thorough.

In an exchange with citizens, the Provincial Party Secretary pointed out that the authorities have paid attention to resolving the citizens' petitions. However, the area that Mr. Pham Binh requested to be granted a Land Use Right Certificate on the cadastral maps of 1993 and 2001 is shown as specialized land. The authorities have all proven that this land was encroached upon by him, so there is no basis for resolving the petition. If he does not agree with the conclusion of the authorities, he can submit a petition to the competent Court for consideration.
