Provincial Party Secretary Thai Thanh Quy periodically receives citizens in July

The Provincial Party Secretary received Ms. Hoang Thi Thanh and Mr. Nguyen Ba Ha, in Nui Chung Forestry Hamlet, Kim Lien Commune, Nam Dan District, requesting competent authorities to resolve compensation and resettlement for 12 households living in Nui Chung area, Kim Lien Commune.
These are households that Dai Hue Forestry Enterprise (now Nam Dan Special-use Forest Management Board) granted to workers to build houses since 1982. Ms. Thanh said: Currently, there are 12 households in the above area, of which 7 households live there permanently, 4 households come and go irregularly, and 1 household has transferred. Since 2012, the province has started planning to relocate and resettle to Mau 6 hamlet, Kim Lien commune because this land area belongs to the special-use forest planning.
However, the problem is that the land area granted does not have land allocation documents from the Forestry Department, and there is no receipt for land use fee payment. Relevant agencies of the Provincial People's Committee and Nam Dan District have sought solutions to implement, including asking for opinions from the General Department of Land, Ministry of Natural Resources and Environment.

At the meeting, Ms. Hoang Thi Thanh also agreed with the plan proposed by Nam Dan district and the Department of Natural Resources and Environment agreed after consulting with relevant departments, branches and the General Department of Land.
That is cash support at a price of 60% according to the land price list regulated by the State on an area of 300m2.2for each household; the remaining part is garden land adjacent to residential land supported according to Clause 2, Article 27, Decision No. 58/QD - UBND dated October 13, 2015 of the Provincial People's Committee on promulgating regulations on compensation, support and resettlement when the State acquires land in Nghe An province.
Regarding the content: "For households without land in Nghe An province, 1 plot of land will be allocated without auction" proposed by the authorities, citizens have not agreed and have requested to reconsider to ensure equal fairness for all 12 households.
After listening to citizens' opinions, the Department of Natural Resources and Environment, the Department of Finance, and representatives of the People's Committee of Nam Dan district, Secretary of the Provincial Party Committee Thai Thanh Quy concluded on the solution; accordingly, he expressed his appreciation for the citizens' opinions that they agreed to relocate out of the above area.

In addition, the Department of Natural Resources and Environment will take the lead in providing full procedural guidance to the people in a consistent, uniform, and correct manner for all 12 households. The Department of Finance will calculate and allocate funds for implementation in 2021.
For the People's Committee of Nam Dan district, it is necessary to review according to the direction agreed by the Department of Natural Resources and Environment, in which the solution is "households without land in Nghe An province will be allocated 1 plot of land without auction" and provide synchronous and unified instructions to 12 households so that citizens can prepare and meet the procedural requirements according to the regulations on land allocation without auction. The above contents will be reported to the Provincial People's Committee by August 30, 2020.
Requesting the Provincial People's Committee to pay attention to and direct the handling of the above content, the Provincial Party Secretary requested the leaders of the Provincial People's Committee and the Department of Natural Resources and Environment to directly work with the Nam Dan District People's Committee to clearly convey the viewpoint of the People's Reception Council. In addition, people also need to actively and closely coordinate with authorities at all levels to complete procedures in accordance with regulations.

The Provincial Party Secretary received Mr. Nguyen Trung Thang, Xuan Dong hamlet, Nghi Duc commune, Vinh city, with a request for competent authorities to allocate a resettlement land plot and 5 residential land plots with land use fees to the co-heirs of the family whose land was recovered by the State to implement the project of building a road connecting Vinh - Cua Lo (phase 1) through Nghi Duc commune.
According to the authorities, this is a special case in the process of compensation and site clearance for the Vinh - Cua Lo road. At the time the State reclaimed the land, the land user was still alive but there was no resettlement area to arrange. Up to now, there is a land fund for resettlement but the land user has passed away. Meanwhile, while waiting for resettlement, there were changes in compensation, support and resettlement policies when the State reclaimed land in the province.
The leaders of the Provincial People's Committee chaired a separate meeting on the content related to the case of Mr. Nguyen Trung Thang's family with departments, branches, and Vinh City People's Committee and on July 2, 2020, a conclusion was announced.
Accordingly, the Provincial People's Committee agreed with the proposal of Vinh City People's Committee to consider allocating 1 resettlement land plot to the co-heirs of the deceased land user to ensure the family's rights at the time of the land recovery decision; at the same time, allocating 1 plot with land use fee to the co-heirs.

As for the difference in area between the recovered residential land area and the allocated land area, if the co-heirs wish to allocate land, the Vinh City People's Committee shall base on the land fund in the local residential land planning areas to implement land allocation with land use fee collection; during the implementation process, the specific price must be re-determined equivalent to the starting price of the land lot (plot) for land use rights auction, ensuring fairness, transparency, and avoiding loss of the State budget. Regarding the allocation of land to whom (among the co-heirs), there must be agreement among the co-heirs, and the procedures must comply with regulations.
After listening to the opinions of citizens, relevant local departments and branches, concluding this content, the Provincial Party Secretary requested the Provincial People's Committee to direct the Department of Natural Resources and Environment and Vinh City People's Committee to study and consider resolving it in a synchronous and comprehensive manner, avoiding causing problems for the entire system and by August 15, 2020, have a specific answer, including the content on the time of calculating land prices, and at the same time carefully study whether it is possible to apply Decision No. 39/2018/QD-UBND dated September 10, 2018 of the People's Committee on amending and supplementing a number of provisions on compensation, support and resettlement when the State recovers land in Nghe An province to this specific case.
