On the morning of March 5, Comrade Nguyen Duc Trung - Secretary of Nghe An Provincial Party Committee chaired the regular citizen reception session for March 2025.

Attending the citizen reception session were comrades: Ho Le Ngoc - Member of the Standing Committee, Head of the Provincial Party Committee's Internal Affairs Committee; Ngoc Kim Nam - Member of the Standing Committee, Head of the Provincial Party Committee's Propaganda and Mass Mobilization Committee; Phung Thanh Vinh - Vice Chairman of the Provincial People's Committee; representatives of the Provincial Party Committee's Inspection Committee, the Provincial Party Committee Office, the Office of the National Assembly Delegation and the Provincial People's Council; and leaders of departments, branches and Vinh city.

Provincial Party Secretary Nguyen Duc Trung received Ms. Hoang Thi Kim Oanh (wife of Mr. Le Thanh Ha, residing at 159 Pham Dinh Toai Street, Vinh City).

Mr. Ha submitted a petition disagreeing with the implementation of the New Urban Area Project West of Xo Viet Nghe Tinh Avenue on his family's land plot in Yen Son block, Ha Huy Tap ward and requested the issuance of a Land Use Rights Certificate to his family.

According to the case file, in 1998, Mr. Ha's family received a transfer of 850m2land of Mr. Nguyen Huu Giao's family, but has not been granted a certificate. In 2006, Vinh City People's Committee reclaimed an area of ​​252 m2of the above land plot to build Pham Dinh Toai Street. Mr. Ha's family agreed and received 80 million VND in compensation, the remaining area of ​​the land plot is 586.5 m2.

In January 2004, the Provincial People's Committee issued a decision approving the detailed planning project of the new urban area West of Xo Viet Nghe Tinh Avenue in Hamlet 19, Nghi Phu Commune. In April 2004, the Provincial People's Committee issued a decision approving the investment project of the new urban area West of Xo Viet Nghe Tinh Avenue.

To implement the project, Vinh City People's Committee issued a decision to reclaim land and approved a compensation and support plan for Mr. Le Thanh Ha's land plot, but citizens did not agree because they believed that the urban planning overlapped with the land the family was using.

Ms. Hoang Thi Kim Oanh said that the matter has lasted for more than 20 years but has not been satisfactorily resolved by the authorities. Currently, the family's house is dilapidated, shabby, damp, and has not been repaired or renovated. The family's wish is to soon be granted a Land Use Rights Certificate.

On June 11, 2024, the Provincial People's Committee issued Official Dispatch No. 4803/UBND-TD on directing the handling of inspection results and review of Mr. Le Thanh Ha's recommendations.

The Provincial People's Committee assigned the departments and Vinh City People's Committee, based on their functions, tasks and powers, to request Construction Joint Stock Company No. 9-VC9 to carry out procedures to submit to competent authorities to adjust the project approval decision, adjust the project's detailed planning, and the implementation deadline is before July 30, 2024.

The Provincial People's Committee also assigned the Vinh City People's Committee to carry out procedures to cancel the land recovery decision, cancel the decision to approve the compensation and support plan for Mr. Le Thanh Ha's family; issue a Land Use Right Certificate (first time) for Mr. Ha's family according to the law; review the responsibilities of organizations and individuals in the delay in resolving Mr. Le Thanh Ha's petition, with the deadline for implementation before August 30, 2024.

However, Construction Joint Stock Company 09-VC9 did not cooperate, did not provide relevant documents and legal documents, so there was no basis to carry out the tasks as directed by the Provincial People's Committee. The Company requested the Provincial People's Committee, provincial departments and branches and Vinh City People's Committee to continue to direct the compensation and resettlement of a land lot on site according to the previously established plan.

After that, the Provincial People's Committee continued to assign the departments and Vinh City People's Committee, according to their functions, tasks and powers, to take measures in accordance with legal regulations to request Construction Joint Stock Company No. 09-VC9 to strictly implement the direction of the Provincial People's Committee in Official Dispatch No. 4803/UBND-TD, dated June 11, 2024.

Reporting on the process of handling the case, Chairman of Vinh City People's Committee Tran Ngoc Tu said that Mr. Ha's family's case has lasted for many years, the reason for the delay is the responsibility of the investor and Vinh City People's Committee.

The Chairman of the Vinh City People's Committee said that the city has repeatedly sent documents requesting the investor to provide relevant documents and records to implement the direction of the Provincial People's Committee but has not received any cooperation. Up to now, Vinh City has issued a decision to cancel the land reclamation decision and the decision to approve the compensation and support plan for Mr. Ha's family.

Director of the Department of Agriculture and Environment Hoang Quoc Viet affirmed that the Vinh City People's Committee's decision to reclaim Mr. Ha's family's residential land to hand over to a business to carry out an urban construction project is not in accordance with the provisions of the 2003 Land Law. The plan for the coming time is to adjust the investment policy, adjust the project planning and assign Vinh City to issue land use right certificates to the people.

Concluding the citizen reception session, Provincial Party Secretary Nguyen Duc Trung said that the citizens' petitions were well-founded and had legal basis; they had been considered and resolved by the agencies, but the resolution was slow and did not meet the citizens' wishes.

Analyzing the causes, the Provincial Party Secretary said that the history of the project has gone through a long period; the review was not thorough and not guaranteed, so the planning approval was not appropriate, which led to the land recovery and approval of the compensation and support plan by Vinh city not ensuring the basis according to regulations.

The Provincial People's Committee has issued many decisions to direct the resolution, assigning clear tasks to departments, branches, and Vinh City. Departments, branches, and Vinh City have resolved the issue but have not been proactive, and have not organized work between agencies, investors, and citizens.

To completely resolve citizens' petitions, Provincial Party Secretary Nguyen Duc Trung requested the departments of Finance and Construction to coordinate with Vinh City People's Committee and investors to carry out procedures to adjust the project approval decision and adjust the detailed project planning to ensure compliance with regulations. On that basis, Vinh City will consider granting Land Use Rights Certificates to ensure the legitimate and legal needs of the people.

The Provincial Party Secretary hopes and requests that the investor actively cooperate to promptly resolve the matter; departments and branches pay attention to resolving the issue to ensure harmony between the interests of businesses and people, in which the interests of citizens are the priority, and report the resolution results before April 15, 2025.
