Provincial Party Secretary Thai Thanh Quy receives citizens at regular session in January 2024

Attending the citizen reception session were members of the Provincial Party Standing Committee: Le Duc Cuong - Head of the Provincial Party Committee's Organization Committee; Ngoc Kim Nam - Head of the Provincial Party Committee's Mass Mobilization Committee; Ho Le Ngoc - Head of the Provincial Party Committee's Internal Affairs Committee; Bui Thanh An - Vice Chairman of the Provincial People's Committee and representatives of the Party Committees, the Provincial Party Committee's Inspection Committee, the Provincial Party Committee Office, relevant departments, branches and localities.

The citizen reception session related to the content of the request for a Certificate of Land Use Rights of 8 households at land plot No. 77, Nguyen Du Street, Trung Do Ward, Vinh City, represented by Ms. Tran Thi Hong, Block 12, Trung Do Ward, Vinh City.

According to the Provincial Citizen Reception Committee, the origin of the land plot previously belonged to a Cinema. In 1986, Ben Thuy Hotel (next to the land plot) requested to build a temporary kiosk with an area of ​​63m2.²on the land to serve the Congress and was approved by the Provincial People's Committee at that time.

In 1991, the People's Committee of Nghe Tinh Province (old) issued a Decision to transfer this land to the Cai Luong Troupe. However, in 1994, Ben Thuy Hotel liquidated the kiosk and handed it over to Ms. Hoa (hotel employee), including the land and assets on the land.

Deputy Head of the Citizen Reception Committee of Nghe An Province, Thai Minh Tuan, affirmed: Because this land does not belong to Ben Thuy Hotel, this unit can only liquidate assets on the land; liquidating assets attached to the land in 1994 is against regulations.

The Chairman of Nghe An Provincial People's Committee received Ms. Tran Thi Hong during a citizen reception session nearly a year ago (March 15, 2023); thereby clearly stating that the above 8 households did not meet the prescribed conditions for consideration of granting Land Use Right Certificates; at the same time, assigning the Department of Culture and Sports to preside over and coordinate with the Department of Finance, Department of Natural Resources and Environment, and Vinh City People's Committee to review, rearrange, and handle public assets on this land; on that basis, calculate compensation for site clearance (if any) in accordance with the provisions of law on management and use of public assets and land law. This content is stated in Notice No. 171/KL-UBND, dated March 20, 2023.

At the citizen reception session on the morning of January 19, representing 8 households, Ms. Hong proposed to implement the contents of Notice No. 171/KL-UBND, dated March 20, 2023 because the deadline for delivery before April 30, 2023 has passed but she has not yet received the results; at the same time, she continued to provide a number of documents and papers as a basis, expressing her wish that the competent authority consider and resolve the issuance of the Land Use Right Certificate.

At the citizen reception session, representatives of Vinh City leaders, the Department of Culture - Sports, and the Provincial Citizen Reception Committee expressed their opinions on the progress and implementation process of Notice No. 171/KL-UBND; as well as reaffirmed the origin of the land plot.

Through the process of monitoring the case, Deputy Head of the Citizen Reception Committee of Nghe An Province Thai Minh Tuan stated that the compensation and site clearance for the above 8 households is unfounded. However, the State agency can consider it from the perspective of supporting citizens to relocate their assets. Regarding the civil transaction in 1994 between citizens and Ben Thuy Hotel, citizens can file a lawsuit in court according to regulations.

Comrade Ho Le Ngoc - Member of the Provincial Party Standing Committee, Head of the Provincial Party Committee's Internal Affairs Committee, expressed his opinion that the settlement should be in the direction of reviewing to respond to citizens in accordance with the content of Conclusion 171/KL-UBND. If after reviewing and receiving the response, the citizen does not agree, they can file a lawsuit in court according to the opinion of the leader of the Provincial Citizen Reception Committee.

Concluding the citizen reception session, Provincial Party Secretary Thai Thanh Quy affirmed that the State administrative agencies are very sympathetic and responsible for resolving citizens' petitions. However, the resolution must be based on the Party's guidelines and the State's policies and laws.

Provincial Party Secretary Thai Thanh Quy requested that the Department of Natural Resources and Environment take the lead in working with relevant agencies, localities and citizens to review all records of state agencies, as well as citizens related to the land plot and assets on the land. From there, advise on whether there is a basis and conditions to consider granting a Land Use Rights Certificate as requested by the citizen or not? and specific handling plan.

The head of Nghe An Provincial Party Committee also requested the Provincial Police to coordinate with relevant agencies to closely review all types of records, especially if any related records are unclear or show signs of erasure, they need to be scientifically examined for criminal investigation to clarify.

The Department of Culture and Sports continues to implement the content of Notice No. 171/KL-UBND, dated March 20, 2023, which is to preside over the review, rearrangement, and handling of public assets in this land. On that basis, calculate compensation for site clearance (if any) in accordance with the provisions of law on management and use of public assets and land law.

Provincial Party Secretary Thai Thanh Quy requested that the above contents be implemented accurately and closely; completed and reported before March 18, 2024, to serve as a basis for specific responses to citizens.
