The Politburo regulates the appointment and introduction of candidates.
Officials proposed for appointment to leadership or management positions for the first time must be of age to serve a full term; assets must be examined and verified.
General Secretary Nguyen Phu Trong has just signed and issued Regulation No. 105-QD/TW of the Politburo on decentralization of cadre management and appointment and introduction of candidates.
According to this Regulation, cadre management includes the following main contents: Selection, arrangement, decentralization, transfer, rotation of cadres and decentralization of cadre management; cadre assessment; planning, training, fostering of cadres; appointment, introduction of cadres for candidacy, dismissal of cadres; commendation, discipline of cadres; implementation of cadre regimes and policies; inspection and supervision of cadre work; settlement of complaints and denunciations about cadre work and cadres.
The regulation clearly states the responsibilities and powers of Party committees and organizations in personnel management, including: the Politburo, the Secretariat, Party committees directly under the Central Committee (provincial Party committees, centrally-run city Party committees, the Central Military Commission, the Central Public Security Party Committee, the Central Party Committees), Party executive committees and Party delegations directly under the Central Committee (Government Party Executive Committee, National Assembly Party Executive Committee, Party executive committees of ministries, ministerial-level agencies, Government agencies, Party delegations of the Vietnam Fatherland Front, socio-political organizations, associations at the Central Committee and the Central Secretariat of the Ho Chi Minh Communist Youth Union).
Officials appointed for the first time must be old enough to serve the full term.
The regulation also clearly states the responsibilities and powers of the Central Party's advisory and support agencies in personnel management; principles, responsibilities and powers, processes and procedures for appointing officials; and terms and conditions for appointing officials.
Accordingly, the term of appointment to hold a position is 5 years for leaders and managers at the head and deputy head levels in agencies and units within the Party, State, Fatherland Front, socio-political organizations, public service units; and State-owned enterprises. The term of appointment to hold a position of less than 5 years applies to a number of specific positions according to separate regulations. The term of holding an elected position is based on the term of the congress of that organization.
Regarding appointment conditions, it is necessary to ensure general standards and title standards according to regulations of the Party and competent authorities; not violate regulations on what Party members, cadres, civil servants and public employees are not allowed to do; have complete and clear personal records, resumes, and asset and income declarations that have been assessed and verified by competent authorities.
Officials of agencies in the political system who are proposed for appointment to leadership and management positions for the first time must be old enough to serve a full term. Special cases will be considered and decided by the competent authority. Appointed officials must be healthy enough to complete the assigned tasks. Officials who are disciplined with a reprimand or higher level will not be planned or appointed to higher positions for at least 1 year from the date of the disciplinary decision. Party members who are disciplined by dismissal from office within 1 year from the date of the decision will not be elected to the Party Committee, nor will they be designated or appointed to equivalent or higher positions. Officials under disciplinary review will not be included in the planning; nor will they be considered for appointment or recommended to run for higher positions.
Supplementing the Party Committee and Party Committee leadership members
The regulations clearly state the addition of Party committees, Party committee leaders and authorities of Party committees directly under the Central Committee and the decentralization of appointment of cadres to lower levels. Accordingly, when it is necessary to add Party committee members, Party executive committee members, and Party delegation members who are lacking compared to the number decided by the congress or within the number frame prescribed by the Central Committee, the Provincial Party Committees, City Party Committees, Party committees directly under the Central Committee, Party executive committees, and Party delegations shall proactively carry out the process of introducing personnel and report to the Politburo and Secretariat for consideration and appointment; there is no need to report for approval.
For comrades who have been introduced by the congress to the list of candidates for the Party Committee election, but the result does not exceed 50% of the votes, consideration for addition to the Party Committee must be carefully evaluated and considered in terms of prestige, capacity, and specific structure, and only carried out at least 12 months after the congress.
For the consolidation and addition of the positions of secretary, deputy secretary, chairman of the People's Council, and chairman of the People's Committee, the Standing Committees of the Provincial and Municipal Party Committees must report to the Politburo and the Secretariat to request policies and plan human resources before implementing the personnel process.
For personnel introduced for election to the Standing Committee of the Provincial Party Committee, City Party Committee; election to hold the position of Vice Chairman of the People's Council, Vice Chairman of the People's Committee of Hanoi City and Ho Chi Minh City, the Standing Committee of the Provincial Party Committee, City Party Committee must seek the appraisal opinions of the advisory and support agencies of the Party Central Committee before introducing them to the Provincial Party Committee, City Party Committee or People's Council for election and reporting to the competent authority for approval or ratification of the election results.
The regulations clearly state the requirements for reappointment and re-election; conditions for consideration, decision-making authority, and reappointment procedures.
Regarding the mobilization and secondment of cadres, the Regulation clearly states that it must be based on work requirements, political tasks, and cadre planning to effectively use and create uniformity in the cadre team; overcome the closed and local situation in each industry, each locality, each organization; and at the same time ensure the stability and development of the cadre team.
Cadres are mobilized and seconded due to work requirements according to decisions of competent authorities. Mobilization and secondment between departments, ministries, branches, agencies, units, the Vietnam Fatherland Front and socio-political organizations at the central and local levels.
When necessary, the Politburo and the Secretariat consider and decide on the transfer and secondment of cadres from other places to take up positions under the management of the Politburo and the Secretariat in localities, agencies and units. The Central Organizing Committee coordinates with the heads and collective leadership of localities, agencies and units (places of departure and destination) and relevant agencies in the transfer and secondment of other positions according to the authority of cadre management.
The regulation also clearly states the process of mobilizing and seconding cadres; ensuring policies and regimes for cadres who are mobilized and seconded.
Procedure for appointing and introducing candidates under the Central management
Issued together with Regulation No. 105-QD/TW, the Politburo clearly stipulates that the positions of cadres are decided or delegated by the Politburo and the Secretariat, and that the positions of cadres need to be assessed by the Central Party Committees; and that the process of appointing and introducing candidates for election is under the Central Committee's management.
Regarding the order and procedures for appointing cadres under the direct management of the Politburo and the Secretariat, based on work needs, the Party Executive Committee, Party delegation, leaders of departments and agencies directly under the Central Committee, the Standing Committee or Executive Committee of the Party Committees of provinces and cities, and the Party Committees directly under the Central Committee (hereinafter collectively referred to as the leadership collective) shall carry out the following steps:
Submit to the competent superior agency (in writing) the policy, number and expected assignment of work for the proposed cadres. For the conferment and promotion of the rank of General, Senior Lieutenant General, and Navy Admiral, the policy of the Politburo must be requested before proceeding with the procedure. The competent agency shall consider and decide on the policy within 10 working days from the date of receipt of the request.
For on-site human resources, after receiving the policy of the Politburo and the Secretariat, within 15 working days at the latest, the agency or unit shall carry out the personnel process in 5 steps. In case of arising difficult or complicated problems, it must report to the Politburo and the Secretariat.
For human resources from other places, after having the policy of the Politburo and the Secretariat, the head and members of the leadership of the agency or unit propose personnel or the Central Organizing Committee introduces personnel. The regulations clearly state the work to be carried out in the case of personnel proposed by the agency or unit; in the case of personnel planned by the Politburo and the Secretariat to mobilize and appoint cadres from human resources outside the agency or unit.
For personnel participating in the Party Executive Committee or Party Delegation, when proposing a cadre to hold a leadership position, if that position is part of the structure that is prescribed to participate in the Party Executive Committee or Party Delegation, or if it is considered that the cadre proposed for appointment needs to participate in the Party Executive Committee or Party Delegation, then at the same time, propose that cadre participate in the Party Executive Committee or Party Delegation.
The regulation also clearly states the appraisal and approval process for personnel under the direct decision-making authority of the Politburo and Secretariat.
This Regulation takes effect from the date of signing; replaces Decision No. 67-QD/TW and Decision No. 68-QD/TW, dated July 4, 2007 of the 10th Politburo and previous regulations contrary to this Regulation./.
