Vote of confidence: Don't let the scope be too broad

On the morning of June 4, discussing the Project on innovation and improvement of the quality of the National Assembly's activities, delegates highly agreed on the vote of confidence for positions elected by the National Assembly. However, many opinions suggested that the vote should only be held for positions of minister or equivalent or higher.

The vote of confidence for positions elected by the National Assembly is one of the innovations that delegates highly agree on and believe that this is the point for the National Assembly to demonstrate the real power of a representative body.

Delegate Pham Xuan Thuong - Thai Binh said that the regulation on the vote of confidence is not new content, because the law has stipulated it, but now the project has included it and is determined to implement it, so that is a new point that should be welcomed. However, according to Delegate Thuong, the project's regulation on the vote of confidence for positions elected by the National Assembly is relatively broad.

"We need to be careful and selective about the positions to vote for, not just any position elected by the National Assembly," said delegate Thuong.

Sharing the same view, delegate Bui Thi An - Hanoi said that the vote of confidence is extremely important because it is related to people, and personnel work must be given top priority. According to delegate An, the National Assembly should vote of confidence annually, once, for positions from minister and above and avoid formalities.

Delegate Phung Van Hung from Cao Bang also agreed that only positions from minister and above should be voted on. However, he did not agree with the annual vote of confidence, but only when necessary. At each session, the National Assembly should ask for the opinions of National Assembly deputies on this matter.

Delegate Vu Trong Kim from Quang Ngai suggested that the National Assembly should only conduct a vote of confidence once every two years, with the rank of minister and equivalent or higher. After the pilot implementation process, the National Assembly will learn from experience and then expand to other subjects. Delegate Kim suggested that the National Assembly should urgently specify this process so that it can be implemented from next year.

Agreeing with the vote of confidence, delegate Ngo Duc Manh - Binh Thuan suggested that it is necessary to build this regulation in a specific and feasible way so that the National Assembly can express its opinions to those elected by the National Assembly. Delegate Bui Sy Loi - Thanh Hoa suggested that in order for the regulation on the vote of confidence to be feasible, the Project needs to clarify the relationship between the agency managing cadres in the process of taking the vote of confidence, avoiding complicated problems.

Increase initiative in law making

According to delegate Tran Du Lich - Ho Chi Minh City, the current law-making method of the National Assembly is still very passive, especially in building the legislative program. According to him, the role of the National Assembly is to proactively propose the program and, in particular, clarify the title of each law and assign the drafting agency to prepare in that direction.

“It seems that we have not had a dialogue between National Assembly deputies and the Drafting Committee. For each law that is submitted, National Assembly deputies give their first comments, then the second comments are on the explanatory report of the National Assembly Standing Committee and the deputies have a dialogue with the National Assembly Standing Committee… We have to review the law-making process,” said delegate Lich.



Delegate Do Van Duong - Ho Chi Minh City also assessed that the National Assembly promulgates many laws, but they are mainly drafted by ministries and branches, then these ministries and branches issue guiding circulars... This means "both playing football and blowing the whistle". Therefore, we must consider changing the current way of making laws.

"In my opinion, we should reduce the issuance of sub-law documents. Instead, we should strengthen the role of the National Assembly Standing Committee in issuing ordinances and resolutions," said delegate Duong.

Delegate Duong also suggested that the coordination between the drafting agency and the current National Assembly committees must be renewed, avoiding one-way coordination. The committees must play the role of examining, criticizing, and reconciling common interests in the law-making process.

“Usually, we tend to make the whole law, which both disperses resources and prolongs the time it takes to build the law. We should strengthen the amendment of some really urgent articles, and put aside the unnecessary ones,” delegate Duong suggested.

Another limitation in legislative work mentioned by many delegates is the delay in submitting bills and implementing laws.

According to delegate Nguyen Minh Hong from Nghe An, the reason why the law was passed but put into practice slowly was because it took a long time to draft the decree. To overcome this limitation, he suggested that it is necessary to increase the number of full-time delegates, because they are good experts in law and should be allowed to participate in all stages from the preparation of the law to the issuance of the decree.

Delegate Phung Duc Tien - Ha Nam suggested that the drafting agency should ensure the law is drafted on schedule and sent early to committees and delegates for research and comments, only then will the law be practical and effective.

We should not "equalize" the parliamentary discussion time for all issues.

Commenting on the discussion in the parliament, delegate Do Van Duong said that the discussion time in the parliament is still spread out evenly for all draft laws, whether the law is simple or complex... According to him, this activity needs to be adjusted to be more suitable in the direction that laws with many important and complex contents that the National Assembly has not yet discussed will be discussed further.

Delegate Bui Thi An also agreed to the proposal that when discussing important issues in the hall, the National Assembly can flexibly adjust the time to allow delegates to discuss and reach the final truth.

Regarding this issue, delegate Tran Du Lich also requested clarification, is the discussion in the hall a place for delegates to speak equally or a forum for the National Assembly to debate and discuss an issue that the country is concerned about? If it is for debate and discussion, then the National Assembly cannot end its work at 5 pm and any delegates who still have opinions can send documents.

"If we determine that as National Assembly deputies, each of us represents voters of the whole country, not just of a particular locality, then the way we discuss will be different," said delegate Lich.
