Supplementing regulations on re-issuance and new issuance of ordinary passports

The Government has just issued a Decree65/2012/ND-CPamending and supplementing a number of articles of Decree No.136/2007/ND-CPdated August 17, 2007 on exit and entry of Vietnamese citizens, including additional provisions on re-issuance and new issuance of ordinary passports.

Previously, Decree136/2007/ND-CPRegulations stipulate that ordinary passports are valid for no more than 10 years from the date of issue and cannot be extended. According to Decree 65/2012/ND-CP, which the Government has just issued, it has clearly added regulations: Ordinary passports that are still valid can be reissued, and when they expire, new passports must be issued.

According to Decree 136/2007/ND-CP, diplomatic passports and official passports are valid for no more than 5 years from the date of issue. Diplomatic passports and official passports can be renewed once, for a maximum of 3 years. Renewal must be made at least 30 days before the passport expires.

In Decree 65/2012/ND-CP, the above regulation is amended as follows: Diplomatic passports and official passports are valid for no more than 5 years from the date of issue. Diplomatic passports and official passports that are valid for less than 6 months can be extended once, for a maximum of 3 years; when they expire, new passports must be issued.

Regulations on seafarer passports have also been amended. Specifically, seafarer passports are valid for no more than 10 years (old regulation 5 years) from the date of issue and cannot be renewed (old regulation was renewed once).

Children under 9 years old are issued with the same ordinary passport as their father or mother.

According to the new Decree, children under 9 years old (the old regulation was under 14 years old) are issued a common passport with their father or mother if requested by the child's father or mother.

Decree 65/2012/ND-CP also adds the following provisions: Diplomatic passports issued to children under 18 years old of those specified in Clause 9, Article 6 of Decree No. 136/2007/ND-CP and official passports issued to children under 18 years old of employees of Vietnamese representative agencies abroad, reporters of Vietnamese state news agencies and newspapers residing abroad as prescribed are valid from 1 to 5 years from the date of issue until the child turns 18 years old and cannot be extended.

Diplomatic passports and official passports are not issued to cadres, civil servants, officers, and professional soldiers in the People's Army and People's Police when they are sent to study abroad for a period of more than 6 months.
