Ministry of Natural Resources and Environment draws experience in the expression of names in red books
After the regulation on registering the name in the red book in Circular 33 caused a stir in public opinion, Deputy Minister of Natural Resources and Environment Nguyen Thi Phuong Hoa admitted that the Ministry needs to learn from experience when drafting legal documents.
At the regular press conference organized by the Ministry of Natural Resources and Environment, Deputy Minister Nguyen Thi Phuong Hoa said that the content of the amendment and supplement to the regulation on recording names on the Land Use Right Certificate (red book) aims to provide more detailed instructions on how to record the name of the land user on the red book in the case of land use rights of a common household; for the remaining land users (such as individuals, husband and wife, etc.)…) still apply according to current regulations.
According to Deputy Minister Hoa, the practice of recording household names on red books as before, in the process of implementing the rights of land users, has revealed shortcomings and limitations. For example, the land use rights of each member of a household are not specifically established, thus facing difficulties in being protected by law when risks arise during the implementation of civil transactions.

Ms. Hoa also affirmed that the issuance of regulations such as Circular 33 is consistent with the provisions of the Civil Code, Land Law and overcomes practical shortcomings and difficulties.
Responding to questions about wording errors when drafting Circular 33, Mr. Mai Van Phan, Deputy Director of the Department of Land Registration (General Department of Land Administration, Ministry of Natural Resources and Environment), said that Circular 33 was drafted in accordance with regulations on drafting legal documents.
According to Mr. Phan, after being assigned the task by the General Department of Land Management, the Department drafted and collected opinions from a number of ministries, branches, and localities, and posted information about the draft Circular 33 on the Ministry's Information Portal; sent documents asking for opinions from the Ministry of Construction, the State Bank, etc.; organized workshops to collect opinions before synthesizing and submitting to the Ministry's leaders for signing and promulgation.
However, Deputy Minister Hoa admitted that in the work of drafting legal documents, specifically Circular 33, there were errors in expression that made it difficult for people to understand.
“The regulation on registering the name of the red book in Circular 33 is a technical correction in the industry. It is easy for industry people to understand, but difficult for people to understand. The Ministry of Natural Resources and Environment needs to learn from this experience,” said Ms. Hoa.
According to Ms. Hoa, the issue of red books is directly related to people's rights, so public opinion is very interested. "We understand very quickly because we are professionals. But in fact, how can we issue legal documents so that all people can easily understand? The Ministry of Natural Resources and Environment would like to receive comments on the way of expression in the process of drafting legal documents," said Deputy Minister Hoa.
