How to calculate time, preferential allowance level and procedures for making documents and implementing preferential policies for those participating in defending the Fatherland
- According to Decision No. 62/QD-TTg, the method of calculating the time to enjoy the regime is the actual working time in the army, police, cryptography or the time directly participating in the war to protect the Fatherland and performing international duties.
In case the subject has time directly participating in the war to protect the Fatherland and performing international duties belonging to different groups of subjects or having interruptions, it will be accumulated. When calculating the time of enjoyment for the one-time subsidy regime, if there are odd months, 6 months or more will be counted as a full year, less than 6 months will be counted as half a year; for the monthly subsidy regime, it will be counted as a full year (12 months).
- Subsidy and incentives: Monthly allowance for subjects in point a, clause 1, article 2, from 15 to under 20 years of work is calculated according to regulations, then they will receive monthly allowance according to the number of years of work. The allowance is 925,000 VND/month, if 15 years, then for each additional year, 5% of the above allowance will be calculated. When the Government adjusts pensions, social insurance allowances and monthly allowances, this allowance level will be adjusted accordingly.
One-time subsidy: If less than 15 years of service, the beneficiary will receive a one-time subsidy calculated based on the length of service, at a rate of 2.5 million VND, if there are 2 years of actual service or less; from the 3rd year onwards, each year will be added 800,000 VND. If the above-mentioned subjects pass away before the effective date of the decision (including those who pass away while in the army or on duty), one of the relatives of the subject will receive a one-time subsidy of 3.6 million VND.
In addition to the monthly or one-time allowance, if the subject has not yet enjoyed the health insurance regime, he/she shall enjoy the health insurance regime according to the provisions of the health insurance law; upon death, the person in charge of the funeral shall enjoy the funeral expenses according to the provisions of the current social insurance law.
- Documents and procedures: The application for one-time subsidy includes 1 declaration of the beneficiary or the beneficiary's relatives (if the beneficiary has passed away), 1 or several original documents or documents considered as original documents, or related documents (original or copy of competent authority) proving the correct beneficiary, meeting the conditions for receiving benefits according to regulations. The application for monthly subsidy is similar to the above.
- Processing procedure: The subject or relative makes a declaration and submits a set of documents as prescribed to the People's Committee of the commune (through the village or block chief) where the permanent residence is registered; the People's Committee of the commune receives the documents, reviews, synthesizes and reports to the People's Committee at the district level through the Military Command, District Police, Department of Labor, Invalids and Social Affairs; the district-level departments and offices review, compare, synthesize and report to the Provincial Military Command, Department of Labor, Invalids and Social Affairs, Provincial Police according to their authority.
The Provincial Military Command, the Department of Labor, Invalids and Social Affairs, and the Provincial Police shall review, synthesize, and report to the competent authority, which is the Military Region Command, the Provincial People's Committee, and the Policy Department - General Department of Force Building (Ministry of Public Security) to decide on monthly and one-time allowances for the subjects according to regulations. This decision takes effect from January 1, 2012.
