Ban on advertising milk for children under 2 years old
Units that produce and sell breast milk substitutes are also not allowed to apply promotional measures such as giving away samples, gifts, discounts, or accumulating reward points... to customers.
The Government has just issued Decree 100 regulating the business and use of nutritional products for young children. This document will take effect from March 1, 2015, replacing Decree 21/2006. Compared to the old Decree, the new document has many more specific and strict regulations on advertising milk products.
Accordingly, the new regulation strictly prohibits advertising of milk products that replace breast milk for children under 24 months old, supplementary foods for children under 6 months old, or feeding bottles or artificial nipples in any form. The use of images of fetuses or young children in advertising of milk for pregnant women is also not allowed.
In addition, the Decree also clearly states that production and business establishments are not allowed to send employees to directly or indirectly contact mothers, pregnant women or their family members to advertise, promote or encourage the use of milk products that replace breast milk.
In addition, the regulation also restricts marketing and advertising measures of milk production and business units. Specifically, enterprises are not allowed to display milk products that replace breast milk or supplementary foods for children under 6 months old at medical facilities. At the same time, displaying names and logos of milk products that replace breast milk on banners, posters and other advertising materials in supermarkets and retail stores is also not allowed.
In particular, businesses are not allowed to apply promotional measures to breast milk substitute products such as giving away samples, coupons, prizes, gifts, bonus points... or any other form.
